Hello

This is going to sound stupid, I have been made aware of section 75. We paid a deposit for a property (off plan new build in spain) which has never been built and were looking into the idea of trying to make a claim.

My problem is I don't know which credit card I used and not too sure of the date (probably 2006/2007).

Does anyone know anyway of finding this information ?

It could be one of 4 different cards!!

Thanks

Just phone the card issuers and ask. Presumably you know how much you paid?

I had a similar issue with a deposit and knew roughly when (4 years ago) and just phoned up and had them check. Thankfully I got lucky and it was one of my RBS issued cards and they were the first I called but it wasnt the first card they checked but they had to go into an archive system as it was too old to be on the main one.

Given you are talking up to 6 years ago you may find some wont have it electronically any more and the idea of getting them to go through microfiche may be more challenging

If you can't get you want by phone, you'll have to write.

The Data Protection Act entitled you to a copy of any information any company holds about you, for a statutory fee of £10

Since the time limit for civil claims is usually 6 years, they probably won't have deleted information from 2006 yet, and certainly not for 2007.

But I suspect you'll need some good evidence to get a refund on a property claim going back that far.

If the total price of the property was more than £30,000 then Section 75 won't apply anyway, how much was it ?
  • Hello

Thanks for the replies. The property price wis £110,000 but the initial deposit was £3000.

    Thanks

    Hiya,

I think I'm right in saying that as the total pice was more than £30k Section 75 won't apply, no matter how small the deposit was.

    Sorry!

Usually civil claims are 6 years, but for land and property it's 12.
You might need to look into that in more detail to see whether it's qualifies.

Little harsh! No I saw it but wasn't sure if it was 100% clear and also as the OP then posted underneath with no relation to your post I thought I'd just answer what I expected might come up next which is "Does this apply even if my deposit was on the card and under £30k?"

    Sorry for any offence...!
