    unfortunately as reported its not so simple to win an online ppi claim, now into the 12-24 month fos waiting queue :(

    Yes but a complaint through a claims company won't make that any faster, because you use the Ombudsman too and end up in the same queue. Only you would charge thousands of pounds for it.

    Also the queue is long but it is drastically shorter than 12-24 months.

    I don't see where PPI disgrace said it would be quicker using a CMC?

    I'd say 12 months is pretty typical for a PPI complaint to go to an adjudicator. If the first decision is contested 2-3 years is what you looking at for an Ombudsman's view.

    If a lender systematically rejects valid complaints in the hope that the consumer will give up, thats where CMCs can add value. CMCs will tell people to continue with a legitimate complaint when going alone they'd often give up. I think at one stage around 15% of consumers were continuing to FOS when there was an 89% uphold rate for PPI!

    However, if your not going to give up and you feel confident, don't use a CMC and you'll save money.

    As the Ombudsman Service have said, the financial sector could get of CMCs in a flash. Its simple really - Just treat customers fairly.

    For example if the banks wanted to, they could automatically refund people's PPI overnight and the PPI reclaim industry would be gone in a puff of smoke. Don't tell me that they don't know who they've mis-sold to. FirstPlus for example, have mis-sold to everyone!

    What makes me laugh is that the Financial Sector hate CMCs and want rid of them, however they fail to realise they could close them all down in an instant - but treating customers in a reasonable way is just too much of an ask.

    Questions:
    1) The enclosed application form is just a printed sheet i.e. I still can't remember whether it was an on-line application or a postal one. Does this matter at this point (given they have rejected) - is there any benefit in requesting an SAR?

    2) In my complaint form, I claimed mis-selling on the following grounds. Is it of any importance that they don't mention the 2nd and 3rd points in their rejection letter?
    • Don't remember ticking any box
    • In full-time employment and entitled to full sickness and accident benefits
    • Pre-existing medical condition (Type1 Diabetes)
    3) Does the fact that they mention 'final response' mean there is no point in asking them to reconsider i.e. is next step automatically FOS?

    I received exactly the same letter as you but mine started with the fact that they hadn't received my form back with the additional information - even though I have sent it back. They enclosed a copy of my application where I had ticked for PPI cover.
    When I applied for the card they actually turned me down. Then a few weeks later they called me telling that they had reconsidered and would like to offer me the card.
    Can anyone tell me if this changes anything- in my favour?
    I am about to send my complaint to the FOS. I have tried to call MBNA but after holding for 45 mins I gave up!
    I have cover through work as I work for the NHS.

    Today I've received a letter (dated 2/5/12) saying thank you for the correspondence(which was posted on 16/4/12) we will deal with your complaint and notify you with our finding in 28 days.

    I haven't a clue what is going on - do they?

    Last week Lloyds b/h wrote back to me saying they had turned my ppi claim down saying that they dint think i was mis-sold the insurance and that it was optional, they also mentioned that because the ppi was taken out pre-2005 it wasnt covered, i was sold this ppi back in 2002 on a private garage forcourt for which they used B/H as one of there finance companies yet B/H are saying i applied for this loan in one of there branches which is obviuously wrong! they say from there evidence that i was sold this loan fairly and knew it was optional, even thou at the garage i was told i could only have the loan if i had the gold-cover ppi...... i have since been intouch with the FOS and they have said that Lloyds will putthe blame on the broker company who authorised the loan and ppi, Ive been back intouch with B/H and they said they stopped using that company not long after i took the loan and ppi out.... im really confused at wot to do next because it seems stange as a small loan i took out with B/H late 2003 they payed my ppi back because i used a claims company, but with this one i did wot they were telling us to do claim for it our-selves, is it just a case the B/H are trying to pull one over me because i claimed with-out using a company?... any help please???? paul.

    I have just spent 40 minutes waiting for MBNA to answer the phone this evening in order find out what s happened to my PPI claim (credit card).
    I finally managed to get an answer and told a rejection letter plus a copy of a signed agreement from 2001 had been sent on the 24th May. Well no sign of that!!
    I asked the nice young man what I had actually signed and I made him read out the agreement to me over the phone..... I noted amongst other things that I was 'strongly advised' to take out the cover.
    Surely this is mis selling?

    I guess I will have no option but to go to FOS as I have had full NHS sick benefits etc for 25 +years....
    Any advice would be really appreciated or I am interested to hear if anyone else has had a similer scenario

    I have read all the above I have had a rejection letter from MBNA saying it is there last response they have not given me any specific reason ie signed forms etc simply states based on info I have given them What info should I go to FOS or try again at MBNA

    Finally MBNA have sent my letter of May 24th which I received today , confirming that they have not upheld my complaint plus have enclosed a copy of the agreement I signed in 2001.
    The letter states it was a non advisory sale and they also forgot to enclose the copy of my signed agreement which is really annoying.
    This rather conflicts with the statement read out to me on the phone by the young man from MBNA on Monday when I was chasing up the claim -'we strongly advise you' - and all the rest.
    I must admit I then said .... you are recording this aren't you?

    So on the one hand MBNA say it was a non advised sale and on the other they strongly advised me to take it out!:eek:
