PPI Reclaim help with no paperwork!?!?!?

Hi all, hope you can help!

I am trying to reclaim PPI on two old accounts, one is for a loan I had with Citi Financial, the other is for a credit card with Egg. Problem is, I have no paperwork or account details! I got the dates of agreement/settlement date from my credit report and sent the standard letter to both of them with a £1 cheque requesting a copy of my credit agreement. Both have come back with the following response:

Section 77 of the consumer credit act states that section 77 does not apply where no sum is or will or may become payable by the debtor. As your account is now closed we are not obliged to comply with this request as we no longer have a contractual relationship with you. Your right to be provided with this document ended with the closure of your account.

Please help, where do I go from here!?!?!? :(

Send a DSAR request and £10 to the lenders, wait 40 days and it should come back with all info they hold about you including account numbers and credit agreements.
Not all CMC`s are the same....:A
  • Thank you so much for your reply but can I be really blonde and ask what a DSAR is!?!?:p:rotfl:

If, of course, they still hold it in a relevant filing system - which basically means "can a reasonably competent temp with no particular knowledge specific to the filing systems of the business find your data with the information you have given them".

If the answer to that is "no" then they are not expected to wade through their archives on the off chance of finding a file of yours.

That doesn't mean you shouldn't do it - only that it might not produce anything.
