I really need some advice if anyone can help me.
My daughter got clamped in the university carpark.. She's been a student there for the past year and was told by one of the lecturers when she started to park in this particular carpark and there's no need to pay as its owned by the Uni that she attends.
Yesterday when she got to her car to come home, she'd been clamped..
The assistant came to her and told her that the council has taken over the carpark last week... Obviously she just broke down and cried.. She had to pay £90 cash to release the clamps and if she paid via card it would be £95... Who in the right mind carries £90 cash in their pockets today???!!!!!!!
Anyway, my husband phoned the council today and was told that they dont run that particular carpark!!!
Can anyone advise me, is it worth writing to the firm? or threaten courts??
Any advice is welcome....

Can you start a separate thread for this as it will get lost in the discussion on the merits or otherwise of the clamping ban.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

Who defines lawful authority as the instructions from a landowner to operate would in theory be lawful.
Also i see an appeal to the EU courts over the human right to protect your property. This bill revokes the right to protect your property.
The impact assessment makes clear that 'lawful authority' refers to the authority of public bodies, such as the DVLA, or the authority of the vehicle owner to clamp their own vehicle to prevent theft:

They are all or have been suspended from accessing the DVLA database for gross misconduct!

The legislation and SIA licence only applies to immobilisation (clamping and towing) on private land where a release fee is charged. In essence, anyone can clamp or immobilise without committing an offence if they are not getting a fee or charge for release. The act does not differentiate between a fee for profit or just to cover costs.
The second thing is that there are people who never need an SIA licence to operate. Police, councils and Customs and Revenue for example, even if they are not operating on a highway.
The SIA was slated as a quango that this government wanted to disband. Which was a shame since they also brought consistency and standards to security and door staff. The government says that the professions overseen by the SIA are now fit for 'self regulation'.
My view is that the SIA would be ideal to oversee the BPA.0 -
My understanding is that the act of clamping, immobilising (including blocking in) and towing is to be banned - never mind the release fee.
