Enforcement officer on doorstep for paid fine

Hi there,

Basically, my uncle got a speeding fine and sent a cheque off to pay it. He obviously didn't worry about it again, and as his most recent bank statement isn't in yet he hadn't been able to check if it'd been cashed.

This morning he had an enforcement officer turn up on his door and demand £390! She said they'd sent him a letter to say he hadn't paid (which he has NOT received) and that if he didn't cough up she'd take goods. He showed her the cheque stubb but she said they hadn't received any payment. He sent the payment about 6 weeks ago.

Is there anything he can do? It would be a bit of a coincidence if the cheque had gone missing in the post and then their letter had also gone missing! Are they just ripping him off?

    Was it a court appointed bailif or a doorstep debt collector that called,the first one has power to remove goods,the second has as much power as a cheap chinese battery...

    Yes he did let her in. We've had that discussion... :)

    Basically he paid up. I don't know if he checked her credentials or anything, I can only assume(hope) that he did. He has gone on holiday today, so I think he panicked and just paid so he could finish packing and go.

    When his bank statement comes I'm going to check to see if the cheque has been cashed. I assume it hasn't because they have conveiniently 'lost it'.

    I have a feeling the answer will be that since he didn't send it recorded delivery then he can't prove anything. Which is gutting for him. Although shouldn't they have to prove they sent their demand letter?

    Sorry, having never received a speeding ticket I don't know who sends them out. Can we work on the assumption that he paid an enforcement officer representing the body who issued the fine?

    My question is really, since he sent them the payment, which they have failed to process, can they legitimately then penalise him for not having paid on time?

    Edit: just to say I appreciate that you may saying that the person who rocked up this morning could in actual fact NOT represent whoever issued the fine. Until I can clarify, I want to assume this hasn't happened.

    Bailiffeadviceonline is called for here, cost about a tenner but well worth it.

    Presumably this was a fine issued by a Magistrates' Court. The fixed penalty speeding ticket doesn't change, if you don't reply it goes to court. It is difficult to get to the bottom of this one without input from your uncle as you clearly are not aware of the details.

    No I don't have all the details unfortunately, I'll have to grab him when he gets back.

    The time scale that we're talking about doesn't seem to fit does it? If it had gone to court it would have taken more time than this. I dont know what worries me more - the thought that this isn't legit or the thought that he is so unfocused on things he's manage to get into this mess.

    And when do you think he will be back to be grabbed ? It may not even be a legit ticket to start with and its cost 400 spondulicks so far . Need lots more info to this story .
