I need to start new post as cant find my original!!
Back in November 2011, I parked in Oak Mall car park Greenock. I paid for my ticket and about 6 weeks later recieved a fine from Civil Enforcement. After reading on this forum I ignored it. I then recieved another and ignored it. That was a few months ago.
However, today I recieved another letter saying not to ignore it and I now owe £355!
I have noticed however it has come from a company called Newlyn in Herts!
Can anyone tell me why its a totally different company now?
Im in Scotland
Thanks
Lynne

Hi Lynne,
They do change the associates and letters from time to time, and Newlyns is well known. You should continue to ignore.
Out of interest, the Newlyn's letter doesn't by any chance have a council reference number on the top does it?
I realise Newlyn's are Bailiffs, but in this circumstance they are acting as debt collectors although they are not averse to trying to imply to the reader that they are acting as bailiffs. Mind you, you are in Scotland, so that would be interesting to see!!Je Suis Cecil.0 -
Newlyin's have no powers in Scotland (as we don't have Bailiffs). As they don't have Sheriff Officers appointed to the Svcottish Courts, they're really just whistling in the wind.
I wouldn't worry unduly, it's still only a speculative invoice.0 -
And even under English law, for things to actually get to this stage, they would have to take you to court, win the case and then you’d have to refuse to pay. Then the bailiffs would be appointed by the court. The acquisition of wealth is no longer the driving force in my life.

Just a part of the campaign to try and scare you into paying money that you don't actually owe to anyone, Lynne.
Treat it with the contempt it deserves. Just ignore them.0 -
Ok thanks for the help. I have no intention of paying them but at the back of my mind there is always a "what if"!!!
Thanks0 -
Oh forgot to mention, there is no council ref only Newlyns and client ref.0

Like in, "If I was being blackmailed and refused to pay, what if they took me to court?"
The acquisition of wealth is no longer the driving force in my life.

OK, thanks. They've been a bit 'naughty' in the recent past, by quoting council case references as if they were being bailiffs enforcing a council obtained warrant for an unpaid legitimate parking ticket, presumably to scare people unnecessarily.
It turned out it was a 'one-off mistake'.
Of course, we have seen a few of them!
They are a particularly unscrupulous company, best ignored, as they have zero power to enforce payment on this unenforceable invoice.Je Suis Cecil.0 -
You need to bear in mind Newlyn are a bailiff company. Therefore when they work for a council, they habitually add ridiculous fees because it is an enforceable debt.
Here they are not working for a council, they are NOT acting as bailiffs, and the debt is totally unenforceable. However they hope you don't know that so are just trying it on.0 -

Relax Lynne2764, & continue to ignore as already advised - nothing but nothing will come of this.
I can assure you that there is no "what if" !!! as far is this pair of shysters are concerned.
They never have & never will 'do court' IMHO - I post from personal experience & not just a little knowledge of them, having been in a similar position to yourself quite some time ago now & no prizes for guessing what happened in my case, or to everyone else who has ignored them for that matter.
In any event, you paid to park - so end of story for you.0
