DLA appeal help wanted please.

Hi sorry if this has been asked before.

I recieved my decision last friday, awarded nothing for care or mobility.

Everything on the letter is the polar opposite of what my disabilities are.

CAB helped me fill in my form and where very thorough. I have today seen a photocopy of the form my GP filled in and it was very much in my favour.

It seems very much like to me like they have sent me someone elses decision (if only).

I called them friday and told them i want to appeal, today i recieved a little booklet entitled 'If you think our decision is
wrong', do i just complete the form at the back or send a letter?

Do they automatically do a reconsideration if i am appealing?
If thats a yes to that question do they wait until i send the form/letter back, or after i have phoned and told them my intention to appeal?

    Yes they automatically reconsider when you put in for an appeal. I believe you have to send the appeal form back before they will look at your claim again as part of the appeal process.
    The bigger the bargain, the better I feel.

    I should mention that there's only one of me, don't confuse me with others of the same name.

    Yes, as Cattie says, you need to send the form back in order to get the process started and another Decision Maker will automatically reconsider the decision. When you fill in the form, tell them that you will provide more details of your grounds for appeal when you have recieved your 'statement of reasons' (which you will need to request seperately. You can do this by phone but, as always, it is best to follow-up with a letter.).

    My father had to fight for years to get his DLA and he has an amputation. However since then I have found out some "people" I know of have been getting DLA for years and they have definitely NO disabilities. This makes me mad that someone like yourself or my dad whom need the funds for care or mobility or whatever have to beg and layabouts get it for no good reason.

    Also for your own notes, make sure you take names and also description if you see them face to face as they have a habit of loosing forms, notes etc when passing them on. At least if you have a record like we did it made our case a lot easier :)

    I presume the 'Statement of resaons' explains how they came to their decision and what their reasons are based on?

    The letter says they are aware i struggle to walk, but as i do walk they can't award me mobility????

    'I can prepare and cook a meal without help'
    Er no as explained i have been unable to do any of that for over 12 months.

    It went on and on with complete condradictions of what was
    written in my forms.

    I'm on 6 different painkillers (2 morphine based) thats 28 tablets just to help get me through the day.

    It really seems like they have based my decision on someone else application, even though i know thats not true.

    Oh well may as well get my self comfy for the long haul of appealing.

    You must know this poster in real life then? You cant have read the same post as us to come to such a profound conclusion that this poster deserves DLA when no information at all was given apart from being turned down and disagreeing with it.

    I am not going to get stressed out by any of this, if the process takes 12 months so be it, stressing is not going to speed it up.

    I have never claimed any benefits or awards before and i find it alarming the hoops alot of people seem to have to jump through to get any kind of financial help. I would be a complete basket case if i had to deal with some of the nightmares i have read about on MSE.

    It seems to me there really needs to be a better process put in place with regards to the dwp having complete access to all specialists etc. I know specialists and consultants seem to shy away from giving patients evidence to support their claims and expect dwp to contact them with a 'form', and the dwp seem to shy away from contacting the above directly. How frustrating is this for a claimant?

    No I do not know the poster, I was just reading through and think it is such a shame people who seem genuine can't get it is all.

    Its a new poster who has given very little information about her claim yet you can read "that she seems genuine" so its "a shame" she didn't get the DLA she wants, you have also decided that there are many people with no disabilities what so ever are getting DLA yet you are not in a position to read this poster or these frauds medical records.

    I assume you have reported all these people claiming benefits fraudulently? Then someone who is in a position to decide on DLA awards can do their jobs properly, thats what DM's are for.

    I believe that my award was successful (after many years) as I aquired numerous articles regarding my condition from the internet and sent them in with my claim. It was successful without question (I did have a medical but think that was routine due to my condition.
    Good luck and if you can get more info. hit them with it.
