    hi im in court in april ive done my court bundle sent 1 to court and 1 to bank (barclays) still not heard from them not even a letter confirming they have it.

    If i do have to go to court, what do i need to say if anything at all?????? Has anyone been to court when they have shown up, if so what did you say to the judge? i spoke to the court and they told me i should attend and hinted that the bank wont but if they do what do i say?????????

    sent letters:money:
    got replies offering half:mad:
    turned them down:T
    took them to small claims court:eek:
    they acknownledged the claim:confused:
    now they have put in a defence:mad:
    going to court in april:eek:
    what should i say????:money:

    i filled in and returned aq on 29 nov 06 court sent date of hearing on 5 jan 07

  • Congratulations I have just started the process of claiming from the Halifax who have responded with a letter saying they need 14 weeks to look into it. Whats that all about, so I don't know if I should wait that length of time or just give them the 14 days before trying again.

  • Are they admiting their records are sufficiently inaccurate and ill managed so as to require 14 weeks?! Do they expect you to believe that they are putting that degree of analysis into your single claim - this would cost them tens of thousands! They are stalling. They didn't require 1 second of human effort to charge you in the first place!

    Well done to the OP and thank you so much for posting!! My claim has been Acknowledged by Abbey and I fully expect my day in Court. As a single mum on a lowly salary, my huge overdraft was run up trying to avoid bank charges, mostly. People (who don't know what it's like) say you should just not go overdrawn - but when your ex spouse doesn't pay you on time, or your benefits get paid a day late and all your DDs bounce, you don't have a choice. And 120 quid in bank charges in one month (or more) can truly damage a tight budget, hence the spiral. And why is it that Abbey always takes their charges a few days BEFORE pay day? Huh? Can anyone answer that one? It's as if they are willing us to not be able to pay them, thereby causing charges to self-perpetuate ad infinitum...

    Anyway, the last straw for me was going 56p over my o/d limit, thereby incurring 35 quid charges PLUS another 20 for going over my o/d limit without authorisation. I would LOVE a bank or a judge to prove to me that charging 100 times the amount in question is ethical or just!! Itching for that day to come LOL

    Has anyone actually lost at the court stage?

    I don't have a just reason for getting in to such arrears and having all my fees charged - just plain and simply poor money management :(

    I have my Court date set for 24th April and am getting the jitters(I am the unluckiest person alive!)
    I will print off your post for reference and I need to get my bundle into Court and Barclays.
    Was this allocated to the Small Claims Track??
    Was it scarey???
