Problems with getting wedding dress

  • As you seem to have reasonably good communications with manufacturer, why not try going down the route of asking the manufacturer to inform the shop in writing that they are no longer holding the dress for delivery as a reasonable time has elapsed. (with copy of letter to you).
    Once you have this confirmation, surely your credit card company MUST then refund you.
    Explain to the manufacturer what you are doing, and then that you intend to purchase it direct.
    Th manufacturer is obviously sitting on dead stock at the moment and should be pleased to get it resolved as well as yourself.

    (I dont know law, but this seems a possibility)

  • send them the small claims form detailed and let them know they have 7 days to reply and it will be filed. Then, after that time, send it in.

    There really isnt much more you can do, but by doing that hopefully the credit card company will see there is an issue. As you have specified an end of contract date.. 3rd of March and they neither delivered nor got in contact its reasonably to assume you wont be getting you dress so I would get back in touch with the credit card company and tell them that.

    Manufactuers say that they cannot get involved as the shop is their customer not me. They suggested I could get the dress from another shop and pay again but this would mean fighting for a refund from the first shop. It would mean I would have dress in 3 days but I could be held on breach of contract by first shop even though they have had reasonable time to get the dress to me. It would then be up to the small claims court to decided who is right.

    I dont know if this would help but how about 'camping' outside the shop and handing out leaflets to anyone trying to get in for their appointment. You could make sure they have appointments booked by ringing up to check what availability they have (get a friend to do it so they dont recognise your voice). May not get you your dress but will definately get them to realise you mean business.

    Are you in the West Midlands by any chance? If yes phone Ed Doolan one of the radio presenters on a weekday morning on BBC Radio WM - he also may be able to help you. He does a phone in show where people call in for consumer advice and basically names and shames if they dont sort out a genuine problem.

    Last resort - Watchdog!

    Whilst all of this might get you noticed, I can't help thinking it's a terrible stratagy if the shop are waiting for the cash from the next order to pay for outstanding orders : the OP will need someone else to go in & place an order so that the shop has the cash to settle the bill for her dress from the manafacturer! I know this is a terrible circle but driving business away at this stage will probably simply drive the shop out of business and then there will be NO hope at all as creditors are paid on a pro-rata basis after assets are sold etc so the OP is likely to eventually only get a very small percentage of her original outlay in this case (And the CC company may insist she wait & see what re-payment is made from the shop before they pay the remainder or they may pay the original outlay then claim the refund themselves but would you want to take this risk?) At the very least I would have thougth driving business away will not get the shop to do you any favours! Tempting though it may be, I would not do anythign like this right now.

    I think I'd go in & cry alot & hope to get somewhere out of sympathy. Remember you catch a lot more flies with honey than vinegar!;)

    I think don't think honey will get any results on this one if there are 40 dresses from the same supplier still waiting to be paid for by the same shop. I would go small claims court at this point...

    If it was me I would be agreeing with the above and filing with the small claims court. You have given them plenty of opportunity to resolve the situation and they haven't even had the courtesy to respond to you.

    Good luck and keep smiling - you have lots of time to get the dress aspect sorted out. I'm sure you will look beautiful when you walk down the aisle x

    I have got a solicitor involved, I sent one final letter today providing their details and saying if dress is not in shop by Tuesday I want a refund otherwise solicitors are taking over the case.

    I'm not in the West Midlands, shop is in Surrey
