Fake goods.

I have purchased what looks to be fake/counterfeit cosmetic products from an online retailer. I only realised that they are possibly fake when I viewed and purchased similar items at a store. I have taken the items to a store which stocks these products and they also think that they are counterfeit.

I have contacted the retailer who have said that I can return the product brought within the last 7 days but I cannot return the previously purchased items including the ones that I have not used at all.

Does anybody know the returns policies for fake products?

Thanks in advance.

Are you looking for something which says... "for fake products, you have up to 21 days to return them"?

If so, you may be disappointed.

There is no return policy for fake products. You do have rights under DSR and SOGA. It's SOGA you need to use on fake products, they are not as described so the company should take them back and refund you in full including return postage. The only problem is getting a company who sell fake product's to care abour your rights.

Trading standards may be interested, if the company don't play ball then take the goods to your local trading standards office for them to send away for testing, they should then follow this up with action against the co, if they are UK based. Some will say give them to trading standards anyway, but this won't get you your money back, so it's either your money or justice, you decide.

The company sells loads of products daily and only the products from this cosmetic company that I have brought are looking likely to be fake. They are based in London and they are only willing to refund me for the product that I notified them about within the 7 days. If they don't refund me for the others them I will be passing them on to Trading Standards. A lot of people have been duped by this site and these products!
  • Before considering any legal action, it might be an idea to contact the manufacturer directly, sending them photographs of the items in question and asking their advice.

It may be that the goods suplied by the online retailer were grey imports (goods imported from overseas and not imported by the manufacturer).
They may be 100% genuine, just not originally meant for the UK market.

Thank you. I have emailed the manufacturer and am awaiting a response. I will see what they have to say but I did take them to store and the products are totally different including the packaging, labeling, texture, colour and smell. I don't really want to use stuff that smells like washing up liquid on my face! I do know people who have brought these products overseas like the US and duty free and they don't differ to the UK brought products.
  • Who are the company that you think are selling counterfeit goods?

How did you purchase them? and how much did they cost?

I would consider a section 75 claim via your credit card provider if you purchased with a credit card once you have confirmation from the manufacturer (or a retailer of the legitimate stuff) confirming what you bought are fakes.

You may also have rights if you bought them with a VISA debit.
    Thinking critically since 1996....

The company is Buyapowa and they were around £10 each. Please see this - http://www.lipssofacto.com/2012/04/buya-beware.html

The store I visited was willing to write on letter headed paper that they are fake/counterfeit products. I paid via Paypal.
