It really is a case of signing a particular form for it. A clause embedded into a contract, unless it is specific to the course / training being paid for, is invalid. I am quite certain about this because public sector employers pay for employees courses a lot, and we have very clear guidance to stay within the law when training agreements are drawn up. They must be signed before a course of training is started, the form must specify what is being paid for, what will be reclaimed (so if it includes time off work, whether this is reclaimable) and the amounts that will be reclaimed alongisde the time periods applicable for reclaiming costs. So the only way that this could be embedded in a contract is if the course was contractual itself. A general statement about deductions does not meet the legal requirements of a training agreement.0 -
Sorry let me clarify.
I work as a sports coordinator and the courses they want me to pay for are a one day Archery course and a 3 day fencing course. I attended these courses in February which they have already paid for.
Without those courses i would be of less use to them. So basically it was for their benefit not mine.
Initially i had plenty of hours but after hearing my manager was training someone else up for my position i had to act to save me getting the boot and go back to the position on my contract. (Long story!)0 -
You've already done the course so IMO don't sign.
They should have made you sign them before you took it.0 -
A lot of companies do this to keep you with then after you ahve had the training and so rightly. After all if this is a course to help you in the job why would they pay only to take your skills elsewhere?
Normally I have seen that companies what %'s paid back if you leave within 2 years and I think that's pretty fair.0 -

At the moment it would make no difference to them. If they lose one of the 3 people in the sports section the other 2 people get more hours rather than the current weather dependent 24 which works out as less than 20.

My contract is 40 hours per week though it does state these hours can change up or down with no real limits providing i have 24 hours notice.
I've been with the company 6 years though only as a seasonal worker so i have to sign a new contract at the start of every season then get laid off in the winter.
(I just had a word with last years manager and he says i shouldn't sign it as it should have been done before me doing the courses.)
It seems the worst he can do is make my life a bit more difficult but i don't really care. He has no grounds to sack me and no grounds to make me sign that agreement.
The sooner i find another job the better!0
