Pipex Homecall/TalkTalk

I have been with Pipex Homecall for about 5 years on what I believed to be an unlimited package, as that's what I signed up to online.
TalkTalk have recently took them over and my account has been transferred to them. At the beginning of April I phoned them up as they had been overcharging me, Pipex gave me half price unlimited downloads, if I committed to a 12 month contract which I did. When I called talk my 12 months contract was up so they sorted out the overpayment and I agreed to another 12 month contract at half price.
Today I checked my account online and discovered that I am now capped at 40GB per month. I phoned their call centre, that was a waste of time.
When I renewed my contract no download limits were discussed, as I assumed that it was still for the unlimited package I was on.
If TalkTalk don't revert me back to an unlimited package (which they say they can't), am I able to cancel the contract, on the grounds that they have breached the contract by changing the T&C ie, capping my downloads to 40GB?

I have no paperwork to confirm what package I was on, as I signed up online and then renewed over the phone.0

I'm also a long term Pipex customer. I also noticed a few weeks ago, when looking back at some TalkTalk paperwork that 40Gb was mentioned. On my Pipex package (without Homecall) I was also "sort of" unlimited, but subject to their "fair use policy", which they once clarified to me as being 80Gb per month. I noticed a few months ago, I'd strayed over the 80 GB, a couple of times, so feared a warning letter. I reined myself in a bit, and kept a closer eye on my downloads. As far as I'm concerned, I'm still on an 80 limit. If they tried to impose a 40 limit, I'd be off, sharpish, which would be a shame after being a customer for many years. I could just about cope with a 40 limit if it was an average monthly limit, but if it were imposed for every month, then it wouldn't be enough for me, and I'd move to another provider.0 -
Yeah, that's what I was on, unlimited, subject to fair usage, but I have never had any problems with my downloads.0

When aquisitions are conducted any customers affected by a change in terms and conditions are sent notification to make them aware of this.
As a consumer you then have the right to either accept the change (which is denoted by continued use of the service on the basis of new terms) or to decline the proposed changes.
In the event you decline the proposed changes the period between notification and implementation of the change allows you to move your services elsewhere should you wish.
If you feel you were not given relevant notification of these changes this would require further investigation for which you are welcome to tweet us @TalkTalkCare or join the Members Forum for full account support.

hi can anyone help i pay by monthly direct debit my home page is now talk talk and i can get my mail from there.i noticed that my direct debit hasnt been taken for the last couple of months.i phoned talk talk about a month a go who said they woulld look into it. but got nothing back so i phoned them again .and was told my number doesnt exist or my pipex account .but ive still got my phone unlimited broad band and free calls.i dont want to get into debt with them what can i do as dont want to be disconnected as i need my number n internet access.i cant get to my previous online bills. i looked on my last email from pipex saying my bill is ready the fone number goes to talk talk0
