Limited capability for work questionnaire

Hi there,

My mum receives DLA and shes now recieved a letter that she needs to be assessed if she can move to esa... She recieved the questionnaire today, thing is my mum is deaf and suffers from schizophrenia and needs constant care by me or my sis. She sleeps for 5 hours in the daytime aswell as throughout the night

How do we get her to fill the questionnaire? She isn't capable of doing her signature anymore so wondering what to do?

    I think she will also be getting Incapacity Benefit or Income Support, which is why she is being moved to ESA.

    One of you could become her appointee,

    The appointee will recieve all letters regarding the claim addressed to them at their address. You should phone the phone number at the top of the letter and explain that you need to apply to become appointee.

    So my mum gets income support at the rate of £0.10 a week or something similar, if this quetionnaire isn't returned, will this income support stop and her dla claim remain unaffected?

    The IS will eventually stop, although they may arrange a medical for her without the form (this can happen where the claimant has MH issues). Whilst 10p may not seem a lot to lose, IS also entitles her to full housing benefit, council tax benefit etc, so I would not take the decision not to return it lightly.

    You should return it as it can and will affect other benefits she is entitled to as well as her NI contributions for her pension, I am guessing she has a care co-ordinator from the mental health team if so get in contact with them and see if they can refer you to the local welfare rights advisor or advocacy. Also I would definitely see if you can get an appointment with DIAL or go to your local CAB for help to feel this form out. Start to gather any and all evidence you can about your mothers conditions and illnesses for copies to send with the form. Her mental health team should be willing to do a supporting letter as well that you can send in with it.

    Does she have a partner?
    Does she have savings more than £16000

    As you can now request that your WCA be recorded by Atos it is strongly advised that you request this to be done.
  • You cannot be too expert on the System as the DWP Job Centre plus don't always give the right advice.
    I would get a Welfare advisor, get all the Support Workers help if you have it and harness your resources.

    Thank you to everyone who has replied, I've taken onboard all the advice and have come to the conclusion that I'll try to become an appointee to my mum some time next month.

    My mum doesn't claim housing benefit nor council tax benefit so it doesn't make a difference if her income support claim is closed as a result of not receiving the fill out questionnaire however I want to be really careful with this with regard to her dla she recieves - she has receieved the medical form and on the envelope it says ESA50 - hence am I right to think that if its not filled in and sent back, she won't receive income support/ESA but DLA will continue?
