I hear what you're saying Stigy but MR, together with several other TOC's, are pushing the envelope with this approach.
There may well be breaches of byelaw(s) but the byelaws themselves are entirely clear about who may and may not be pursued for what.
The only person liable to a penalty such as the OP has been offered is the owner of a vehicle involved in a breach of BL's 14(1) to 14(3). There is no provision for a driver/person in charge of a vehicle involved in such a breach to be offered a penalty and as set out the only option is for the driver to be summonsed.
But what evidence will the TOC have as to who the driver was at the time?
Besides, several TOC car park signs purport to offer contractual parking. Doesn't this approach smack of having your cake and eating it?My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).

The TOC has probably seen what a good deal the private companies are getting with the "penalty" fares, so they are kicking out the PPCs and doing it inhouse, falling back on the Railway Bylaws to get the money out of people.
I wonder how much Merseyrail and the like make from "penalty" charges in car-parks0 -
If he pleaded guilty then, you can not argue about what law applies, you have said everything they are about to stand up and say is true, before they have said it.
