  • So if they don't cancel the invoice for £70, say if the badge was not displayed, even though I am sure it was, should I write back with stronger words to the effect of breach of the Equality Act 2010 and harassment esp at my and my mums recent bereavement.

    I have not stated who was driving in my 'appeal' letter.

    If they don't cancel the fake PCN when you have told them your passenger was disabled then they break the law when they continue to harass you (as your Mum's driver). Your Mum has a case against them in that scenario, if they continue with this harassment/discrimination.

    She was entitled for whoever was driving her to park the car in that bay. She doesn't need a Blue Badge at all as they DO NOT APPLY on private land.

    What I would do is make sure that the parking company AND Tesco have been told in writing that your Mum is disabled - maybe send a version of the letter you sent to Tesco, also to the PPC.

    But check it first to make sure the letter is sent from your MUM not you (well you can do it all for her, but put it in her name), and that it does not name the driver or even say 'my son/daughter's car'.

    The letter should say summat like:

    'Re Parking Charge numberxxxxx. Take notice that I am disabled, here's the proof even though I know it's not actually a requirement to show a Blue Badge on private land. I am showing you this to prove my legal entitlement, as a disabled person, for the driver of xxxxx car to park in a disabled bay that day. I now consider the matter closed and any further contact, to myself ot the registered keeper of the car, will be considered harassment and I reserve the right to take appropriate action without further notice to you.'

    Keep a copy, make sure your Tesco letter said the same - if not then send a copy to the Extra Store Manager by name (his/her smiling mugshot may well be on display with a name underneath, by the CS desk, if not ask for his/her name). Do not actually tip them off about the Equality Act breach, that's for later.

    THEN if the PPC - Tesco's Agent - still send the usual letters, collect them in silence! Come back here and update us and we can help. It would involve a fairly straightforward small claim costing about £75 depending on how much your Mum decides to claim for the breach. Plus you then add on the Court fee and expenses/travel if you actually have to attend Court. In practice, Tesco would settle out of Court and would NEVER let this get that far but they WOULD pay out!

    Let's have something clear, whether they cancel it or not, you don't pay it! If they don't cancel it THEY pay YOU!

    As a matter of interest, does the vehicle have a disabled tax disc? Doesn't matter if it doesn't.

    Unfortunatly these companys prey on the vulnerable, and in most cases people will just role over and pay up, for all those without a voice, or who are intimadted/scared/conned into paying up, please keep the presure up on Tesco regarding the breach of the equalitys act ( disability)
    Effective car park management isnt about slapping tickets and overchaging ( in effect a penatly charge) the public.

    Effective car park management is to do away with the vultures whom are only in it for the money and do it "in-house" if deemed absolutely necessary. Private parking companies are only in it for the money.

    Has anyone ever tried writing on the envelope 'Return to Sender' without opening them. That is assuming they have the return address on the back and are identifiable as to what they are before opening them.

    No but if they are franked I keep popping them back in the box and they come back next morning and they get charged each time, eventually I fine them £70

    There isn't too much point in that so far as I can see. If you are thinking of suing for harassment then you need to read and preserve the evidence. Also, not likely to happen in your case, but there is one company that will seize on the opportunity to start a court case if it thinks the addressee has moved, so that the claim won't be defended and will result in a win by default...

    I wondered if they was getting returned regularly not opened this would cost them more in £ and time by keep resending.

    Your way is just as good but I bet your postie thinks he's stuck in groundhog day delivering the exact same looking letter each day :0
