Kindle case damaged my Kindle

Bought the Kindle 4 last October and also a black leather case from a large company via Amazon who also sell on their own large website.
Ive had the Kindle in the case until a few days back when I got the Kindle touch and wanted to sell the Kindle 4. I look after my gadgets and when I come to sell them they are usually immaculate.
I took the Kindle out of the case for the first time and noticed some black marks the size of two 10p pieces on the rear of the Kindle plus some black smudging around the back edges. Ive tried using a damp cloth and some mild detergent but it wont come off. The two circular marks are aligned with the back of clasp on the case.
I went back onto Amazon and looked at the reviews for the case which are mostly very complementary however there are quite a few reviews mentioning the dye from the case staining the back and the supplier wanting nothing to do with the issue.
I emailed the seller but didnt get a response. I cant sell the Kindle now as 'as new' due to the damage. I have contacted Amazon who say they have no service to replace the back and that the only option would be to buy another Kindle.
Im intending issuing a letter before action to the company selling the case. Should I claim for the full cost of a new Kindle, or just the loss in value in selling a damaged Kindle. Im also going to claim for the case value too. If it went to County Court I would have thought it would be clearcut that the case caused the damage but Im unsure as to what I can claim.

Many thanks. Sounds very similar. Shame there has been no update or resolution posted.0 -
I'm sure I've read similar where Amazon were perfectly happy to replace the kindle."Growth for growth's sake is the ideology of the cancer cell" - Edward Abbey.0

Thanks but it wasnt a case supplied by Amazon. It was another seller on their site.0 -
You can claim for the value of the damaged caused.Im intending issuing a letter before action to the company selling the case. I.e. the value of a replacement Kindle the same as yours but without the damage, minus the value of yours in its current condition.0 -
You can claim for the value of the damaged caused.

which is the same as:...the loss in value in selling a damaged Kindle.
Kev, any idea how much that might be? If you are only talking about £20-30 it is a fair amount of effort for such a small sum.Thinking critically since 1996....0 -

Thank you. Always good to have confirmation of these things.

Thanks all. They have just come back and offered a refund for the case plus £20 compensation for the damage. Tending to think I should cut my losses. What do you think?0

Take the money. You've still got the kindle and the case. I am sure you can get at least £60 for the kindle and case on Ebay (even with the damage).
Afterall the damage is only cosmetic and if you leave the kindle in the case you can't even see it. I've had a kindle for about 2 years now and don't think its ever been out of the case! This is a system account and does not represent a real person. Just sell it in the case, the buyer will be non the wiser unless they replace the case.0
