ESA ending

Right, so i wont get on my soap box but i really need help with this one. All i will say is that my wife has been told her right to claim ESA is to end on Monday (i have appealed, as i did last time, as her claim is totally legitimate, and to be honest its disgusting it has been cancelled AGAIN!!!1), so my question is.... does my wife have to wait for weeks and weeks before being allowed to claim JSA?

I work (which apparently is one of the reasons her contribution based ESA is being stopped) so i was just wondering if she will be able to claim JSA immediately or is their a process to go through? She has been out of work for 2 years (whilst on ESA) but has worked for the previous 11 years since leaving school, we have 2 children (3yr and 1yr) and so obviously my wage alone will not support us, can someone give me some advice please, as me and my wife have no experience with the benefit system and are a bit confused by it all :)

    You are only allowed one year of contribution based ESA and then it's income based and as you say you aren't entitled to that although she would still get her NI contributions credited. The only way she will still be entitled to ESA is if her condition is severe enough to warrant the support group as there is no time limit for contribution based here.

    Depending on your income you may be entitled to WTC or CTC.

  • we get CTC, but lost our WTC when she left work, i was given a reason for this by H+M Customs, but cant for the life of me remeber what it was :s It truly is disgusting that she was on contribution based ESA in the first place, all becasue we both worked. The benefit system is tailored to people whom take it for a ride whereas the actual genuine people like my wife have to contend with mediocre service and half arsed support. Anyway like i said i wont start as last time i got all my MP's involved it was that bad.

    With the exception of the WTC and CTC what else can we do as wether they want to except it or not my wife simply cannot work at the present moment in time

    She can't claim JSA as the same eligibility criteria are used to determine if she would get it. Also as you say she is to ill to work so couldn't undertake what is needed to comply.

    does anyone know if she can claim JSA?

    she would need to have paid sufficient NI contributions between Apr09/10 and Apr10/11 which by the sounds of it, if she has been off for 2 years is unlikely
    she would also need to be actively seeking work
    you will find she can claim to get NI contributions paid although if the child benefit is in her name then she will not need to do that
    does she have care or mobility needs? if so you could look at DLA
  • I know she does have care needs (none physical, just more emotional), however the woman whom interviewed her for her ESA says she does not :s this country is going to the dogs more and more each day.

    The criteria for ESA and DLA are very different - and DLA is not means tested.

    You admit that you have no experience of the benefits system, you make a wholly inaccurate statement about why you received contribution-based ESA, then criticise that system, of which you appear to know nothing.

    You cannot claim that the system is "tailored to people whom take it for a ride" when you are obviously ignorant of how the system works.
