Clothes return after wash?

Hi there,

Yesterday I purchased a Rivington shirt for the high street store, Bank. I always put new clothes in the wash before wearing them. I put the white shirt in the wash with other whites and set it to the temperature that was on the label. When i pulled the shirt out I discovered that the buttons, that have a kind of wood effect, had run and stained small yellow patches by the buttons. It has only been two days since i bought the shirt, i still have the receipt and I havent actually worn the shirt yet.

Does anyone know my refund stance in this scenario?

Did you set the machine to the recommended temp for that particular shirt or did you just stick on a high temp whites wash?

If you've followed the recommended washing instructions then you should be entitled to a refund.

I used to work as management at BANK.

The procedure is for any items that have been washed to send it to a third party and external company to be inspected. They will then send back a report to Head Office who will in turn contact the store.

Usually the company confirms a fault and a refund or exchange is offered. If however they say the washing instructions were not followed, the garment will be sent back and a refund/exchange refused.

    Hope that helps.

Sounds like the buttons are dyed and the dye has leached into the fabric. Assuming you followed the washing instructions, you are entitled to take it back and ask for a remedy under the SOGA.

TBH, a repair or replacement wouldn't really fix the problem, so I don't think there's any harm in asking for a full refund.

How would they know? I'm always a little suspicious when I hear of refusals because of something like this. The onus is on the retailer to prove that the instructions weren't followed and I'm curious as to how this is actually 'proved'.

In all honesty I don't know and I don't know which company it actually goes to. Part of me thinks it goes to the actual manufacturer, but I can't be sure - it's been a couple of years since I left the company.

What I will say is it was very rare for a garment to come back with a failed testing notice. I worked for the company on and off for around 6 years and sent hundreds for inspection. I can only think of a handful of results that were failed - and even then it was blatent that they'd washed it after wearing it (blaming the washer for a hole when the fault is a big slice in the material).

If it's a known problem as well, the garment won't be sent off, a refund/exchange will be offered straight away.
