According to that 53% of claimants are found to be fit for work and no longer eligible for ESA.

It's a shame there's no stats for the appeals, I'd be interested to see how many of those 53% had their claim re-instated on appeal.

It does state there is no stats for appeals but I think its known another 50% or so succeed.

What it does lay to rest is the fear of appealing and having benefits taken away altogether, Though there is a school of thought to put people in WRAG in order to, at a later date, transfer them onto JSA??

I don't know, it's a mine field to understand the system so every bit of info helps.

I received my medical report from my last medical in March where do I find the form that had the points allocated on? I have been put into the support group. On the medical form I have found 1or 2 things that are not correct is it worth telling DWP?

Thank you so much, it's the first time I've actually understood it! :T

From what I gather he should be determined automatically to have limited capability for work because of the special circumstances (he has dialysis 3 times a week in hospital), he does also score a lot more than 15 points on the limited capability for work test.

I've also had a look at the "treated as having LCWRA" and he does meet one of those descriptors too. So he should really be in the support group but we'll just have to see what they say when he's finally transferred over. We haven't heard anything about the transfer yet so we don't know when it's going to happen.

:) Come the time of transfer it is likely he'll be asked to complete an ESA50 form. Return with that any supporting evidence you have.. especially if they confirm the criteria you've mentioned. With any luck he'll be saved a face to face medical and automatically placed in relevant group upon paper based scrutiny.

So you've got your medical report (ESA85) copy... after being placed in Support Group.

Convenient place for the main descriptors is here.
    WRAG - http://www.tameside.gov.uk/esa/wca
    Support Group - http://www.tameside.gov.uk/esa/lcwra
There are special circumstance criteria that can apply too that qualifies you for one or the other group.

If you look at the medical report you should see 17 sections regarding the WRAG categories... for many it probably says 'none of the above apply' or something like that. For others you should probably see a statement that appears in the first link above... but in the link above the associated points are given.

Later in the report it should describe any Support Group descriptors that apply or special circs... the second link may help identify.

It's important to note the medical report isn't the actual decision by the DWP regarding your work capability assessment... it's just (usually) powerful evidence used... so powerful that often it is in effect rubber stamped by the DWP.

You've found a couple of things that are incorrect. To be honest that's quite remarkable... I would think typically they have many more..lol. I would be inclined not to waste your efforts regarding those errors unless you felt that they could pose you a problem in a re-assessment at a later date. On the subject of re-assessment you should find a prognosis in the report (towards the end) saying something like 'a return to work could be considered within x months'... that will almost certainly indicate when you are likely to next be re-assessed.

    Hi,
can someone please help me? I was assessed as being able to claim work related esa last september, this benefit is sue to end in May.
I have been told I cannot appeal because I have left it too long. This was the first time I had applied for any benefit and did not understand the system. Also, the day before the medical a close relative had committed suicide and I was very very distressed.
If they won't let me appeal on time grounds what can I do. I have been told I was put into the work related group because they were unsure how my illness would progress. I have a degenerative joint condition. If the benefit stops, can I reapply? When would I be able to reapply? Please help.
    regards

    More info required
Why is it due to end? Is it because you are on Contributions element?
Do you have a partner? Do they work? How many hours a week?
Do you have savings more then 16K?
