HELP..kids live with me but ex is claiming tax credits!

Hi, was wondering if anyone has any info that could help me...i recently split with my partner...ive moved out and the children now live with me and my new partner...we have had to do a joint claim for tax credits but the tax credits people say we cant claim for my children because my ex is claiming!...ive explained that the children live with me but apparently we have to fill out a form and he has a month to reply...and he could lie and say they are living with him.....if we both say they are living with us then i think we have to wait even longer till someone comes out to check!...they wont pay and money until its sorted and havn't payed us any since the 12th march.....its desperate times now.....any help appreciated!!...

Can you get any further proof that the children live with you, to support what you say? Maybe the school would write to confirm that your address is the registered address for the children, and that you drop them off/pick them up.0

You will both (you and your ex) be sent a letter asking lots of questions, ie where the children are registered with the doctor, who takes them to school...
Unfortunately these type of conflicts are the cases that do take time to sort out with tax credits because they cannot remove tax credits from someone already claiming until they are 100% sure they are not entitled to.
TCO deal with lots of cases like this at any one time and this can also add to the waiting time. I would gather as much evidence as you can and as soon as you recieve something in writing from them, get it all abck to them so they can make their decision.0 -
Do you claim the child benefit in your name (most times it is paid to the mother). This seems to carry weight with the tax credits as well.

My kids came to live with me in March of this year, they are registered at my address, doctors schools are in my address so is chid benefit (that took 6 months to get changed into my name) my kids have only seen there mother 4 times since they came to live with me and my partner, we joint claim tax credits as my partner has 3 kids and I have 2, tax credits accepted that the children live with us, yet in July of this year my ex decided to appy for the tax credits again, we recieved a letter from them stating that they had recieved another claim for the children and we had to fill out the form they sent asking who takes them to school who does there laudry etc etc, we filled it in and sent letters from my exes own solicitors stating that she has only seen her children 4 times since march, medical cards, child benefit letter, letter from my exes father stating he has the children once a month and that he can confirm they live a our address, they recieved our reply back 4 days later than the date they wanted it by, stopped our tax credits and awarded it to her, I have now sent the appeal in by special delivery with all the proof that the children live with us, and stated that her claiming the tax credits for these children means she is committing benefit fraud as she has clearly stated that she has only seen her children 4 times since March!! does anyone know how long the appeal process takes and they likelyhood of us getting the tax credits back? I reported her for benefit fraud also as that is what she is doing, she lives a 2 hour drive away from us and her address is also 2 hours away I dont understand how they can award it to her when we have sent so much proof and child benefit is in my name? totally fed up with the way this system works, they lose millions in benefit fraud yet its right in front of there nose and they do nothing to stop it! its the 3rd time she has applied for benefits for these children she failed to tell the they were no longer with her and owes them 1400 quid! and yet they hand her more makes me so angry0
