Can I be LEGALLY clamped? I OWN a flat on a complex. I also PART OWN the freehold of the land. We have permits for residents, but I failed to display mine for a few minutes while visiting my flat and was clamped. I showed the clamper my permit, but to no avail and had to pay £80 to get the clamp taken off. The management of the complex were unsympathetic, but I feel there is no legallity in this. What do you all think please.

There are a few cases like this over on pepipoo, first of all and this is impotrant check your lease/tenancy agreement, if it says you are entitled to a space and nothing about permits then they have trespassedd on your property.
again check your lease/freehold/rental agreement now.
if it doesnt mention anything about permits etc conitnue as below:
2: did you pay by credit card? of so phone your CC company up and ask for a charge back as the payment was made under duress.
3: inform the management company who eomployed the clampers that they are jointly and severly liable for the actions fo their agents, in this case the clampers, and you want a full refund or you may take legal action agains the clampers, the clamping bod who put the clamp on your vehicle, and most importantly the people who employed them ( management company)
4: also inform them that if any imobilisation device is fitted to your vehicle again, while in your space you will use whatever means required to remove, and or destroy such a device so as to make your vehicle usable, and that the clamping company/management company may also be charged costs for doing such a thing ( angle grinder hire/bolt cropper purchase)
5: issue a letter before action to the management company and the clampers to get your money back - someone else on here will have more on how to do this.From the Plain Language Commission:

You should be looking to opt out of any permit scheme, goodness knows why so many residents accept these in a car park where you have exclusive right to your own space. They have trespassed, not you. Sue them - National Clamps I suspect - and jointly name the managing agent.
Get help on pepipoo if up for suing - but do NOT be tempted to just sue the clampers alone, that would be totally pointless:

Read a few clamping threads on there like yours - there are several on the first few pages entitled 'clamped in my space' etc. Everyone is like you and about to sue if they have the balls for it - you can get this money back.
Start your own thread there with pics of the receipt and the signs/space.
