Unable to get benefits?????

Iwondered if anyone had any advice. I am a sufferer of CFS.

I am awaiting my tribunal for ESA so i was on assesment phase and have recieved the letter saying it will be stopped at the end of the month. I rang DIAL up and they basically said because my husband works we cannot claim anything. My hubbys wages pay our mortgage and our bills so we have no money left for shopping etc the money i was recieving from ESA was paying for this kind of stuff. The hubby suffers epilepsy and has been off work over 2 weeks after having a number of seizures ( 3 in the last 3 days). I am wanting to know if there is anything else we would be able to recieve. I applied for DLA and was turned down DIAL advised me not to appeal but to reappply .

    I would question the reason for not appealing DLA.
    It will admittedly take some time, but unless you are able to submit a more compelling argument, there is little point in reapplying with the same information.

    Did you get a statement of reasons on the decision not to grant you DLA (assuming it was in the last month).

    Your husband may be able to claim DLA in about 3 months time, if he continues to suffer from epilepsy which he has no warning of.
    He can claim ESA now, if he is made unemployed.
    Due to your lowered household income, you may be enetitled to some HB or CTB.

    Other than that, the only way for your ESA to resume payment is for you to be put into the support group, or for you to move out.

    I dident read that bit right just re read it - dont think i want to be moving out of my home and leaving the hubby & kids!!

    For means tested or income based benefits (note this doesn't apply to contributions based ESA or DLA), household income is taken into account for benefit calculations. Household expenses are never a factor.

    You can double check your entitlements on the Turn2us online benefit calculator to make sure you are getting the right tax credits, any council tax benefit due, for example, until such time you receive DLA or ESA.

    Other than that, your only option if you can't increase your income through employment is to decrease your expenses. Download the MSE budget planner and work through the site to slash your household spending.

    How much does your husband earn and are there any household debts?

    Thanks for your reply this is really helpfull

    My hubby brings home £1200 a month and yes i know this sounds a lot but our mortgage is £500 plus all of the usuall bills which takes up the best part of his wage.

    I will take a look at the calculator and budget planner

    Advising - no.
    Pointing out realities in the legislation - yes.

    In a some cases, couples will be driven to separate by this legislation.

    Will some of these be couples that were going to split anyway - certainly.

    Some however won't.

    It seems to me the whole welfare state has become a bit like a game of poker.

    You've got to be
    - in it to win it
    - know the game
    - be dealt a good hand
    - and know when to call bluff!!
    (not to mention have a few quid in order to participate)

    It makes a mockery of the whole point of looking after the vulnerable.

    Saying that, I had 3 queens once and folded.

    I had the best hand and could've won £17!!:eek:

    Proves my point, you've got to be on top of the game, all the time and unlike me, don't get distracted.:rotfl:
