AIUI the fridge is now the buyers, and the seller has agreed to store it pending collection. If they sell the fridge to someone else (and it's not theirs to sell) then they may be guilty of theft, and the person buying the fridge will have no title to the fridge and it can be claimed off them.

It wouldn't be theft. It would be a breach of contract. Nothing more.

And whether a third party takes good title to the item is a very complex area of law.

It would be theft as they wuld have stolen the fridge which now belongs to the purchaserand sold it to someone else.

    Thanks everyone for your help!
Sadly she caved in before I could get back in touch with her. They talked her into accepting a different fridge, and she agreed because she was getting stressed, and she felt like they were accusing her of tampering with the price labels. Oh well, at least she didn't let them charge for delivery...

    Thanks! :)

Sorry, but there has to be intent to steal and I doubt this would be considered theft.
  • Also might freecyle, freegle and gumtree be of any use to your friend?
