I personally think its wrong that anyone should try and reclaim a charge, which they were told at the time of signing up, would be applied if they missed a payment or went over their credit limit! They should take better control of their finances!
Ok, in some cases of genuine mistakes yes, but not when I read posts about £500 in charges, how else are you to learn?

I am in total agreement with you on this matter. As you have said, no one is perfect and yes there may be the odd slip up, but we need to accept it and try to learn from it.
I find it really hard to see how people are claiming back £1000's from a bank over the last 6 years; I just can't fathom how people let it get that bad, but perhaps i am being naive.
Either be careful with your spending, or if you don't accept the charges, then do not sign for the CC!Regards, Robin.2011 MFW # 34

I used to think the same, I had actually had about £700 of charges on my credit card over the last 5yrs. But I thought well it was my own fault, I did go over the limit or miss a payment etc.
Then after doing a lot of reading about it I found that it is to do with the charges being unfair, yes you should be charged if you break the rules but it does not cost £20-£30 to send a letter. I thought , !!!!!!!! to it if you can get them back then you might as well have a go. So I have just recently started to claim them back, hopefully im succesful and if I am well thats my credit card paid off and then it will be cancelled.0 -
Sorry but I couldnt agree less with the OP. I agree that people should learn to manage their finances but often these charges are often not the fault of the payee, if your finances are out of control (as mine were at one stage a few years back) then this punative money making by banks and credit cards just doesnt help and can make the situation considerably worse.
Also as they are unlawful (as can be determined by the banks unwillingness to defend the issue in court) then anyone should have the right to reclaim. Being told in advance in no excuse, if a burglar phoned me in advance to tell me his intent to rob me while I was on holiday would it makes his actions any less illegal, NO.
For clarity of where my position is, I have reclaimed in the region of £12,000 in the last year including a considerable of interest. The whole thing came about through a less than successful business venture and the serious financial hole it put me in, it took 3 years to dig myself out and I still have a pretty large though manageable amount of debt related to it.0 -
A minority will benefit from reclaiming charges that they already knew about, having read them and agreed to them.
The majority will now suffer increased charges for banking and credit cards due to the incompetence of the minority in handling their own financial affairs.

the fact that credit card charges have dropped dramatically due to the legality of them suggested that in fact you will not suffer increased charges
and if you handle your money properly this shouldnt affect you, no?HSBC CC - £3000 / £3000

No one forced me but I'm sure you can see my point. Just because someone has signed something agreeing to something, doesnt mean it cant be challenged if it becomes apparent that it is unfair.
I havent seen anything as yet in any credit agreement I have ever signed about signing away my legal rights.0 -

Think the OP was referring to annual fee's / higher APR's / service charges etc. Which have already started increasing / becoming more commonplace.0 -
I totally disagree with it, but the thing that really gets me is the people celebrating receiving back large sums of money.
They should be dignified and accept it, however as their greed comes to the forefront once more they celebrate like they have won the FA cup. Why should people celebrate not being financially organised? Whats worse is that there are usually loads of other people around to slap their backs too.
They may have escaped on a loophole/techincality, but old habits die hard and it wouldnt suprise me if these same people are still regularly going over limits and not paying on time.0
