it comes with a 'passcard'. it's basically a DS cartridge with a slot for a MicroSD memory card which you add the DS games onto. it's not illegal if you actually own the games you have backed up.

actually it is illegal under UK copyright law as unlike the US we have no "fair use" clause.
It is especially illegal if you sell it (as in an ebay auction)

It is NOT illegal to sell games you legitimately own on Ebay.

I was just about to say it would be a flash cart. DD Has one on her GBA that also fits in the DS.

Fabulous thing, but bit of a pain having to keep reinstalling different games when she's had enough.

what i mean is that it is perfectly legal to have your own backups for software that you legitimately own as long as it is used privatelyh

Yes, but by selling only the backup software in the auction, without the originals, breaches copyright.
Which is exactly the issue here.
It's BOUGHT (to Buy), not BROUGHT (to bring) AND you cannot be frauded, only DEfrauded.

Please do not buy animals from a pet store. Visit your local sanctuary or centre and give a good home to an unloved or abandoned animal.

No it isn't. It is copyright infringement, except in the specicfic case of Computer Programs (which could be does not include games as they are copy-protected and it is illegal to break the copy protection). See http://www.ejcl.org/103/art103-10.pdf for a fairly indepth discussion of the issues.

I would agree, I always understood that to be the case, eg making tape (or mp3) copies of a cd you own is illegal. Not that you are likely to get done for it.

But I dont get the doc you linked to, this actully conradicts what you said, not that I am legally minded enough to take it in, but it says on page 2:

"With regard to computer programs, lawful users can (see CDPA 1988 sections 50A-50C):
    • make back-up copies."

so you've certainly confused me lol.... can anyone explain?

The CDPA is the Copyright, Designs and Patents Act 1988. Link to the full document : http://www.opsi.gov.uk/acts/acts1988/Ukpga_19880048_en_1.htm
