Lloyds tsb ppi -turn down

i received my first letter saying they were turning me down on y ppi claim. I have had this credit card since 1988. I previosly requested a copy of my agreement to be told they only have to keep for 10 years and no longer have it? In my "turn down" letter they say according to records i signed in branch - true, i asked for a copy so we will see. They also state that i did not have additional insurance elsewhere - I did then but i am having difficulty proving, I also have had before and since a severe asthma condition. Hospitalised twice and on medication. Finally at time of taking card the Manager then actually encouraged me to borrow more on a mortgage than would normally be allowed. This was fine and no problems, when I applied for credit card the sales guy said i should consider taking insurance because of high mortgage!. The bank says it is not their policy nor do they have evidence to show there was any pressure selling.
At the time of taking the credit card i had Critical illness cover and "Key Man" insurance from employer, however the employer has ceased trading and i cant prove this fact. When this happened i replaced my insurance elsewhere.
They seem fairly ccertain they will not pay ? have i any chance and can i go back as far as 1988

That is reasonable.timberplus wrote: »I previosly requested a copy of my agreement to be told they only have to keep for 10 years and no longer have it?
It is unlikely they will still have that either. In my "turn down" letter they say according to records i signed in branch - true, i asked for a copy so we will see.
The onus is on you to provide the evidence, I'm afraid. They also state that i did not have additional insurance elsewhere - I did then but i am having difficulty provingFinally at time of taking card the Manager then actually encouraged me to borrow more on a mortgage than would normally be allowed. Ditto
"Key man" cover is there to protect the business in the event of your illness/death but it does illustrate the point that relying on cover purchased by an employer can be risky. At the time of taking the credit card i had Critical illness cover and "Key Man" insurance from employer, however the employer has ceased trading and i cant prove this fact.
Lloyds TSB have been automatically upholding complaints but seem to have cleared their backlog and be working on the basis of the balance of probabilities. To uphold the complaint the person assessing it has to be persuaded that it is more likely than not, and not merely equally likely, that your assertions are true. Without evidence, that cannot be done.0 -
Thank you
Re comments about me signing in branch - would this be the original agreement?
Remember they have stated to me this was kept for 10 years and then? They have told me in writing they did not have this and now they say they do?
What about me the fact i strongly believe they implied it would be in my best interest and finally, the fact i have had severe asthma since I was a teenager, this was never discussed as an exclusion
Should i give up or consider other means of claiming such ad visa claims company
Thank you again0 -
Hi all.I am a NEWBIE on here so please forgive me if i am on the wrong thread(if thats the right word).Im looking for some advice on a PPI claim i made to Barclaycard.I have had a credit card with them for many years and in December 2011 i lost my job and was unable to keep my payments up and due to this fell into arrears with Barclaycard and a few other card lenders that i had.I contacted all my lenders and i was succesful with 3 of them paying out but Barclaycard have said yes they owe me but they will be deducting it from my outstanding balance.I know this sounds reasonable giving that i do have an outstanding balance but i just wondered where i stand on this one a the others have paid out?
Many thanks in advance0 -
yes lloyds are rejecting a lot more claims
could mse advise after todays summits what are lloyds rejection % to compare Jan - April this year, April figures have been startling by all accounts?!
did they also discuss the team from lloyds calling people after they have submitted a claim?
thanks mse0 -

That is because they are doing what they are supposed to do and investigate complaints, rather than simply upholding them and paying shareholders' (= taxpayers' = our) money whether redress is justified or not.
How would mse know confidential commercial information about Lloyds TSBcould mse advise after todays summits what are lloyds rejection % to compare Jan - April this yearApril figures have been startling by all accounts?!
I suppose it must have come as an unpleasant shock to find that your lies are now being challenged.did they also discuss the team from lloyds calling people after they have submitted a claim?
Probably too busy discussing you lot calling people and persuading them to make a complaint about policies that never existed.0 -
Yes they will probably take what they are owed out of any redress to you im afraid:otheresagreen81 wrote: »Hi all.I am a NEWBIE on here so please forgive me if i am on the wrong thread(if thats the right word).Im looking for some advice on a PPI claim i made to Barclaycard.I have had a credit card with them for many years and in December 2011 i lost my job and was unable to keep my payments up and due to this fell into arrears with Barclaycard and a few other card lenders that i had.I contacted all my lenders and i was succesful with 3 of them paying out but Barclaycard have said yes they owe me but they will be deducting it from my outstanding balance.I know this sounds reasonable giving that i do have an outstanding balance but i just wondered where i stand on this one a the others have paid out?

It is - if there is evidence.
If there is no evidence then you the complaint ought not to be upheld. That is based on the longstanding principle that he who asserts must prove.0 -
that isnt true, it's a case of the banks doing whatever they can not to pay out
its a case of it actually not being very easy to win a lot of claims using the downloaded template, its a case of lloyds now looking for ways to reject claims they were accepting 3-4 weeks ago, its about a cost cutting exercise now for lloyds and others, and once again it is the people who lose
your an ifa , enough said , the banks and finance houses pay your commissions, your on the payroll, so to speak0 -
you can tell ppidisagrace works for a claims company from the number of mistakes he keeps making. After all, they only need to know how to put a stamp on an envelope.I am an Independent Financial Adviser (IFA). The comments I make are just my opinion and are for discussion purposes only.
