Section 75 PIP Claim

This one has probably been covered to death but i still don't get it so here we go again.

Here are the facts :)
  • I paid for my wifes PIP implants on my credit card...
  • The implants have ruptured
  • She has had them replaced at our cost.
Now i have contacted Lloyds Credit card services and they have said go away there is no creditor / debitor relationship... which i can understand however........

If i purchased a sofa for my mum on my credit car and it was faulty i could still claim?!? if i purchased fridge for my Nan on my credit card and it was faulty i could claim?!?

But if i purchase something for my wife which is faulty i cannot?!?!?

Can someone explain this to me please and advise if you think i should take it further?!?!?

    You wouldn't be able to claim for either the sofa, the fridge or the breasts. Because you've bought them for someone else.

    Only your own breasts would be covered, unfortunately.

    Because in the case of your mum you own the sofa but have given it away, ditto for your Nan's fridge although that is still iffy. In the case of the implant you have never owned it.

    As they say there is no creditor/ debtor relationship for the implant but it still exists in your other 2 examples.

    You could say they were bought for your own use and your partner just looks after them for you.

    Like buying a car and leaving it in a neighbours garage when not driving it.

    I believe the argument is that you did not buy the goods, somebody else did and used your card, (albeit with your permission) to pay for them.

  • Please read my new thread my partner paid for my implants they refused to pay so I went to the fos they went in my favour grated full refund good luck
