ESA appeal told me to go away

Yesteraday i went to my ESA Trunibial where there was a doctor and someone from DWP. i always throught there were ment to be 3 memebers. what happened is i went there with all the files and my xrays of my spine to show them that my spine is curved at a 62C angel and my letter from oxleas saying about social anxity and depression. when the clerk ask me to come in they told me that i have to come back. i was very stress i said but i got my xrays and they said they wanted drs file. but i kept telling them that i asked my dr and he just done it but refused to give it to me.

why did they turn me away if i had xrays of my spine letters from oxleas and i wanted to show them but i got the idea i was a lier and that they did not belive my x-rays

i was stressed and even more depressed when i left there

any advise on what i can do

    hello OP so sorry it's made you feel anxious, it doesn't sound like it was handled very sensitively.

    I am not sure there is anything you can do other than wait for a new date for the appointment when they have recieved your doctors files, but you could ring up and explain how it made you feel or wait til the next appt to mention it. hope it won't be too long for you to wait.
  • i dont know it did stress me as i was hoping that i could score the points and prove to them that i'm not able to work. my chest also sticks out and i awaiting for serval opreations to correct my spine and chest. but she did not even care its like they just wanted me to go up there to take the pi** and tell me to go home

    Perhaps you need to look at it more positively. Maybe they need the drs file to be able to make an informed decision about your appeal. I dare say the file will explain more to them about your physical and mental disabilities than an x ray will.

    Very often people with anxiety problems don't present themselves very well verbally at things such as tribunals, so I think if I were you I'd try to be thinking that it might well be a good thing that they want to see the information from your dr before making a decision. It doesn't sound to me as if any of them disbelieved you, I think this is just your anxiety kicking in.
    The bigger the bargain, the better I feel.

    I should mention that there's only one of me, don't confuse me with others of the same name.

    It still may not be that bad, after all x rays don't lie..
    I think they are generally being like this with everyone right now..

    Did you read what happened at my medical the other day...I posted a thread.....
    Is there an upper tribunal ??
    I always take the moral high ground, it's lovely up here...

    Elle, you can only appeal to the Upper Tribunal on a point of law. This needs specialist advice as most of us have no idea what might constitute a point of law!
