My Case - 3rd letter (final notice)

Hi guys,

I posted here a few weeks ago when I initially got my invoice and since then Ive received a few letters and my Final Notice to Owner letter a couple of days ago which looks exactly the same as the stickies example.

When I received the invoice I was parked in a 'restricted area of the car park' (car share space which you need permits for) unfortunately on that one day my permits had slipped off the dash and were not visible :(. The invoice was for a reduced price of £30 as long as I paid within 14 days but I now 'owe' £100

When I first posted on here about the invoice I'd gotten I was panicking and generally terrified of the consequences of not paying, I was getting constant reassurance from all of the great members but I was still really worried... I think what made me slightly less worried about the whole situation was the facts surrounding my case

1. The car park is free (so is the 'restricted area' ... The permits are also free)

2. I've proven I have valid permits.

Just wanted to thank all of you, great community... Also a massive thanks to FA for his great, continued advice! :) hopefully I'll continue to hold it together!

Also, there is one question I have
The PPC say that they have photographic evidence of the breach... How do I go about getting a hold of a copy of this evidence? Would just like to see if they have managed to get a clear picture of my cars reg and the empty dash in one photo, seems like it could be pretty difficult to me .

    Why should you want/need to see it? As you well, know, you owe nothing, and the PPC don't really have a case. Photographs are not evidence, and would not really assist their case (if they even had one). Don't worry about it.

    You have no automatic right to see any photos they have. If (and that's a very big IF) they were to attempt court, and were using the photo as part of their "evidence", then you would get a copy. As it is, the only way I could see is by using your rights under the Data Protection Act to get any information they have on you. It'll cost you, though. Some PPCs will let you have photos for an "adminstration fee". But even starting down any route involving asking them for photos will flag you as a potential mug, and you'll get even more c**p from them.

    Just don't bother.

    What about tickets that are based on entry/exit camera evidence? Overstaying a free period? Return within an allowed period? I'd expect to see the photos. Otherwise, what's to stop PPCs sending tickets to random victims in the knowledge that some will assume that they must've done something wrong and pay up?

    I agree with that, if the ticket is automatically generated by ANPR, but what S.T. is saying is where the notice is issued manually and left on the car it's different.

    Have seen some incredible cheek with PPCs wanting an "admin fee" for photos, on a par with the swindlers who demand the full payment to be sent with an appeal. People unfortunately do fall for these cons, thinking they are dealing with a reputable company.

    Yeah thanks guys, it wouldn't make any difference to me if they were to have photos I was just a little confused as to why I hadn't seen the photos yet. I was confused a little because a lot of cases which I've seen or heard about on here have sometimes had letters sent with photos, it must just be a company thing though or like entry and exit type thing like you mentioned :) thanks!

    Wouldn't put it past them, it just got me thinking about the fact that it could be difficult to get a clear photo of my car reg and dashboard with no permits so I was interested to find out if they had managed it :) I wouldn't dare think about asking for them though, especially if it meant giving them some kind of payment or administration costs

    Most likely it will be a picture of the back of your car parked up in the "permit" bay or a picture of the side of your car, or maybe a picture of your bonnet.

    The registered keeper of vehicle has a legal right under the Data Protection Act for a copy of the happy snaps / videos etc but they can charge £10 for providing the copy.

    If it went to court then they would have to provide copies of the photo's etc as part of their evidence and as such you would get a copy

    I did some research in the meantime, and found a report of NCP getting caught doing this back in 2004. Unfortunately, the links have expired, so I cannot corroborate this.

    It would be so easy to do. Altering the time on one of them would probably be easiest. If you could find two photos of two identical cars, you could copy & paste the number plate across. I worry myself at times.
