Doesn't matter if it is clay or not - it is a layer of grass above compacted rubble.
And don't forget that they take away the top soil first. If they're good builders they bring it all back again, but top soil has a value!
Building firms know that people who buy new builds on small plots tend not to be gardeners, and that their initial focus is likely to be on matters other than the outside space.0
