PCN with overdue MOT

Hi all,

I was issued a PCN earlier by my local council for parking in a residential area, which i was annoyed about because there were no clear signs or anything. But that's not a problem i will pay the fine so it's cleared.

But because of this, to my shock i realised that my MOT is overdue by two weeks. I'm going to get it sorted asap, but my question is whether or not the council will be aware that I have no MOT, because there's no way i could afford a £1000 fine. So at the moment i'm very worried!

Would appreciate any advice!

    Book an MOT as soon as possible, and keep the vehicle off road if possible until it goes for MOT. It is unlikely the council will know or find out, but if you had an accident or you were stopped by the police, that would be a different matter.

    You are insured with or without an MOT although if you wrote your car off then you may get less for it! Even though most polices say the vehicle must be MOT'd.

    A £1000 fine is the highest penalty that wont happen it would be a no points FPN from the BIB.

    However to answer your question, no the council will not be aware or bother that you have no MOT!

    No difference if the vehicle is not MOTd in regards to the insurance, it's an urban myth that your insurance is null and void, and it's not a fair term for the insurance company to put into their policy T&Cs , there are loads of threads about this in the motoring forum.

    But the advice of keeping it off the road is correct as it doesn't stop the police from getting it towed if they see it and run a check.

    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?

    The only way that a failure to have an MOT will affect insurance is if there was a defect in the vehicle which caused or contributed to an accident. One of the conditions of your insurance is that you will maintain the vehicle in a roadworthy condition and the MOT is evidence of this. However the absence of an MOT does not invalidate insurance automatically!

    To answer the OP's question confirm that the Council is not responsible for checking MOT, it is the Police who do this, so the issue of a PCN is irrelevant.

    And, it's always worth appealing the council PCN on the lack of signage.

    The council will automatically reject the appeal, so it will have to the adjudicator stage.

    PS. When you get the new MOT, use the "Tart Alert" on this website to remind you of the expiry date. It's designed for use with credit cards, but works for all sorts of other things. Input the expiry date, the text "MOT", your mobile number and/or e-mail address. 6 weeks before the date, you will get an e-mail and/or text reminder.
