    Did he put the claim in writing to them and if so, did he keep a copy of the letter? If not, that's your first step. However, if he's already put it in writing, and had a written response denying the claim, then your next step is to contact the ombudsman.
    I think that any sort of claim, whether or not you use a solicitor, is going to take some time. It like saying how long's a piece of string really :( I wouldn't imagine the ombudsman treats these cases any differently.

    Hiya yeah he put it in writing it went to there legal department thats whatbthey came back with what i put above,that im not the debtor,its absolute joke shouldnt matter who a purchase is for as long as your family thank you again,i think il go to the omburdsman they seem see things in a diffrent light thanks billie

    Yeah they will take them out but wont replace,but as i have had 2 operations i dont want to be left deformed with all loose skin,i dont see why i should just have them removed without replacement didnt ask for non graded silicone be put there in first place i had a 10 yr guarantee.dont want them replacen but its a matter of having to.

    If there is no debtor/creditor relationship, there is no Section 75 cover.

    Otherwise ANYONE would be able to claim for ANYTHING as long as they knew someone with a credit card.

    Yeah i assumed that but reading martins blog on this situation someone asked same question as there partner paid via c card he replied as long as ur a family should be ok.my partner has had a benefit (no silly comments please) as i was so depressed in myself before afta having children and after this what he paid for for me we are and still alot happier,if that makes sense,ive put this to them so just wait see what they come back with now thanks

    I think your best bet would be to get legal advice.

    I think before spending any more money (OP is already dealing with CCCS for their debt situation) the cardholder himself should ring the FOS for some 'free' advice.

    After all, the FOS must have been inundated with referred claims and requests for information on the PIP situation and no doubt will have a 'policy' on the matter, being as (I would imagine?) most people will have financed this type of surgery with credit (credit cards, personal loans, clinic finance, etc).

    You don't need a copy of the T&Cs of the card, because all that will say is that "you may be able to sue us..." - or words to that effect - (as has already been said earlier in the thread.

    You're dealing with the Law here, the Consumer Credit Act, not credit card T&Cs.
