Query re petition for bankruptcy

I have a bit of a query; apologies if this is long, I want to try to set it all out.

I have a debt from a printing company when I ran my own business. I have acknowledged the debt, and have been making payments of £35 per week to them.

However, I recently set up a self managed DMP and have sent them a letter saying I want to drop the payment to £35 per month, as my circumstances have changed.

I also put in that letter that all correspondence was to be done via post.

I have just received the following email:

"Dear ***,

The petition for your bankruptcy has been sent to *** Combined Court Centre with a court date pending.

Upon receipt of the court date I will advise you further.

Kind Regards

Richard Hughes
Litigation Manager
Final Demand Ltd"

Final Demand are the company I have been paying, but when I agreed the £35 per week I did it over the phone, mistakenly and set up a standing order.

Can you please advise on what I need to do?

    I owe £1578.79.

    I am quite willing to pay, but they are not having any of it.

    Just not sure what to say to them!

  • I'd write to them by recorded delivery and say you'll be happy to confirm to the Judge at your 'bankruptcy hearing' that you are prepared to pay them £35 per month and will be prepared to accept the judge's decision on the matter.

    Just as a quick aside it costs them nearer £1400 to make you BR so you are in an even better position :)

    Btw it costs them nothing to send the threat of BR.

    Do be aware that whilst you have to decide yourself if you think they will go through with it, the whole amount is now due and that amount is above the limit of £750 and so it is within a judges power to make you bankrupt. The smallest amount i have personally seen someone made bankrupt for is £758

    regarding hteabove...if the OP attends the BR hearing [to disagree with a BR petition], then, as quoted from above,
    confirm to the Judge at your 'bankruptcy hearing' that you are prepared to pay them £35 per month and will be prepared to accept the judge's decision on the matter.
    would that not be a reasonable assumption?
    No, I don't think all other drivers are idiots......but some are determined to change my mind.......
