Faulty DS - anything I can do?

Morning all,
am hoping someone knowledgeable will be able to help me with an ebay enquiry please.
I bought a new Nintendo DSi console at the end of Nov 11. It was a christmas present for my niece to replace her previous broken console. I checked it when it arrived (early Dec) but then it wasn't used till after christmas.
The touchscreen is now faulty, after less than 4 months use.
I've messaged the seller (in Hong Kong) and they've asked me to return the console to them, and they will look at it and possibly replace depending on what's wrong with it. I've told them I don't want to do that as I'll then be out of pocket for the postage and I won't even have a console. They have said they'll refund the postage later but I just feel that I'll be end up with even more expense and nothing to show for it.
Do I have any rights at all here? Can I make them give me a refund, or a replacement, and then send them the faulty console afterwards? Or is my only option to send the console back at my own expense and hope that I hear from them again?
I'm very reluctant to take a faulty (but kind of functioning) present off a child with no guarantee that I'll ever get anything back.

I think you will have to find someone who knows the law in hong kong.. the advantage of buying from the uk is we have tighter legislation in case of problems.
I cant see a way that the seller will refund first. I dont think sellers in the uk will refund first without return nevermind in hong kong.0 -

You may even find your console is a fake item. Not a geuine Nintendo product.
Only buy stuff from china that you are willing to throw away if it doesnt work.
Your well outside the paypal/ebay dispute time so you may send it to them and never hear anything ever again.
There wont be much you can do.
