Adding a debt to my IVA

Options
Hi all
I'm having a little trouble (so does everybody else it seems) in understanding how the following works and what I should do.

Basically,I have been in an IVA since june last year and all my debts were covered.I had an ongoing mobile contract which had ran smoothly for years. a bit later in the year I had incurred a huge phone bill due to going abroad and not turning off data roaming. I struggled to pay it back and it spiralled out of control. I called my IP for help and they said that as the contract was taken out before my IVA was approved then it shouldnt be a problem including it into my IVA. I sent them the letter, phone contract details etc and was told to leave it with them. That was weeks ago and today ive received a letter from the company acting on behalf of my phone provider threatening court if payment isnt made in full within 14 days.
I have phoned my IP and now I've been told to phone the phone company to see how much of the debt was incurred before my IVA was started. So , I did as they asked and was told that basically I owe the full balance as soon as the contract is taken out but you just spread the payments....therefore the whole ammount was incurred before my IVA.
I tried calling my IP back but it was just after 5pm so missed them.

Does anybody know from experience how this actually works and what information I should try and get.

I'm a little worried as if I have to stand to it then there is no chance I can afford it. I feel a little let down by my IP as I was told it was possible,in hand and to just leave it with them. After doing this they have made no contact to me whatsoever with any updates or to request more info. Its now left me in a worse position (if it cant be included) as its gone on for longer.

Any help would be really appreciated.

Thanks
Bry

  • From the sounds of it your IP is going to help you, so phone them in the morning with the info that is required by them.

Dont stress so much until you have to.
