Can my landlord do this?

I have been currently renting this property since last december. On the day i moved in i was left a list of things that would be fixed. My boys bedroom raidator and back fence to name a few.
He inlisted a "freind" to carry out the repairs. 3 months later!

On the first visit i wasn't given 24 hours notice and was already out when i recived a text saying this "friend" would be there soon. As I wasn't back in time we arrange another date. Wich was last weekend, this "freind" is now saying he came round again and I refused him entry sending him mocking text messages. Telling him to wait outside as he wasn't getting in.

My lanlord has now said if I don't pay 125 punds i will be served notice. As he paid this guy then had to take a day off work to fix the fence! I can prove i sent no texts and he wasn't at door. so beging to think I'm being done. also raidator still isn't fixed

Any advice would be welcomed I live in Scotland and my tenancy ends in July

    Which country do you live in? England, Wales or Scotland, as the law is different.

    I would ask to see these alleged texts as they will show the number from which they were sent and you can obviously point out that this is not your number.

    Learn from this though.....make sure that all communications in writing and keep copies.

  • Thanks I have asked for them but as forwarded text don't I presume they are just taking his word for it. I did send photos of my phone screen showing exactly what text I have sent with date and time attached. This doesn't seem to be enough wich leads me to belive they are just trying to scam money out of me.

    What would I do? I'd WRITE to the landlord, reminding him that the contractor they appointed cannot ahve called round to the property as you were expecting him, and that you did not refuse him entry. That you are being accused of refusing entry is a mystery to you, as it would be to your advantage to have these outstanding repairs addressed. And then ask whether it would be possible to arrange a convenient day and time for it to take place and that you would like that arrangement to be confirmed IN WRITING. As you deny that you refused the contractor access you will not be paying anyone's £125 call-out charge.

    Fully expect your landlord to seek to end the tenancy in July. Sounds like you'd be better off elsewhere in any case.
  • Yeah after July i'm out of here. He isn't trying to say it's for a call out charge but that he had already paid him for the days work. He also claims that part of the money is for his loss of wages for having to take a day off work to fix fence!

    I am refusing to pay as I find the whole thing rediculous. I rented another property for 3 years before this one and never had an issue like this.

    As far as I can see he enjoys taking my rent but not paying for things to be fixed.

    Also is it against the law not to have recieved my energy and gas satey certificate. I have asked for both but never recived them!

    Right, that's a clear violation of the law. Talk to Shelter but you'd be better off starting to look for a new house. In the meantime, dont pay the £125, and WRITE as you have been advised why not.

    Which council are you under? You need to check if this guy is registered as a landlord. If he is not, tell them. If he is, explain that he has refused to provide your energy and gas certificates. He is committing at least one criminal offence from what you say.

    Stop texting, do everything in writing.

    And? Who cares what the money was paid out for? You didn't instruct the contractor so were not party to whatever arrangement they arrived at between them. You know and I know that your landlord is being strung along and ripped off by their mate/contractor and that's got nothing to do with you.

    Write your letter and do it now. Get proof of postage at the post office and keep it safe. Also keep a copy of your letter for future reference as you're probably going to need it. Do not be bullied by this a-hole because this a-hole is going to try and make a deduction from your deposit if you don't cough up that £125 and your letter is going to be evidence later that you don't owe it.
