Mitigating circumstances

I bought a ticket and placed it on the dashboard (non-adhesive ticket). As my wife closed her door on the driver roadside the ticket must have blown off. Consequently we got a PCN. I appealed and was rejected as the ticket wasn't displayed. In the reply the council sent a photo of someone else's car! I appealed again am now in line for Notice to Owner letter. I feel very aggrieved. does anyone know my REALISTIC chances of continuing to fight it.

    Yep, you have a very good chance of winning.

    This is known as a 'fluttering ticket PCN' and if you Google that term you will find MSE threads and pepipoo forum threads all about it as well as an important 2006 CHief Adjudicator's Report about this very thing.

    Most cases can be won, even better that the Council have sent you a rubbish reply which is a procedural impropriety on their part.

    Yes you can make formal reps when you get the NTO and you should win in the end even if you end up going to adjudication.

    What you do need is a copy of the Traffic Order for that place. It's important, as you will see when you do your research and find and read that 2006 Report I mentioned. You can email for the Traffic Order now, or go into the main Council offices and just ask for a copy which they have to give you (no need to mention the PCN).

    Finally, post a pic of your PCN on pepipoo, and the P&D ticket; start a new thread and get expert help from now on. You stand a far better chance of success with pepipoo forum advice:

    IF you read any thread there where the title says 'ticket fell off dashboard' or similar you will learn more. In fact one page 3 at the moment, there's a success just reported by the user 'ukdeveloper' where a pretty well-worded letter was used to get it cancelled. You could try using a version of that letter now (you do NOT have to sit & twiddle your thumbs, fuming and waiting for the NTO, you are allowed to add more informal appeals before the NTO). I would try your version of that letter once you have done some reading of the issue starting with that Google search.
