Hays recruitment payout - no more ripping off temps

Without Prejudice
Having read many stories of Hays Recruitment and their dubious pratice of quoting pay rates, only for temps to receive pay slips showing deductions for holiday pay, my family member (i am being careful here because of an ongoing tribunal case) took them to task and decided to pursue what in essence appears to be an un-authorised deduction through the available legal process.
After hearing all sorts of excuses from Hays and having carefully studied the terms of engagement together with Hays own assignment confirmations - and most importantly not taking no for an answer, Hays have today offered back pay to the value of all holiday deductions to all of the staff on my family members contract. They have stated this is a "goodwill gesture" but as we all know employers dont tend to give money away on goodwill!!
If you work for hays check your terms of engagement and if the section about deductions does not specifically mention deductions for holiday entitlement then you may too have the right to make a claim.
Hays it would seem have a habit of issuing assignment confirmations that do not state your rate will be inclusive of holiday pay, if this is the case for you - then hays have broken the Agency regulations act and you can get YOUR money back from them, beware they may try to blind you with science and change your terms of contract mid way through an assignment, again this is not legal and you do not have to accept this.

At the end of the day if enough people complain and make claims maybe they will end this misleading practice.

This is happening to my friend, Hays deduct 10% of her wages for holiday pay. Recently her hrly pay has been increased from £12.24 to £14.09. I guess it is because of the agency regulations act which came into effect last Ocotber. Funny enough good friday bh, Hays paid her only £11.48 hrly for 7 days. She does not want to ask questions because she is a bit worried in case they cancel her assignment. Thanks0

I took on a 5 week assignment 4 weeks before the end of the financial year. I was working towards a deadline so couldn't take or didn't need to take any holidays. Well, I accumulated about 20 hours holiday pay before the end of financial (EOF) year. I worked one week over EOF year and when I requested my p45 I only received the holiday pay I had accumulated for the one week I worked after the EOF year. which was less than 2 hours worth. When I actually received my P45 there was no details on there, it said that I have paid 0 tax and I'm annoyed because I'm eligible for a tax return. I shouldn't have to call them.

You need to wait for your P60 to see what tax has been paid in the previous tax year - or look on your week 52 / week 53 payslip as that should be your end of tax year figures, then make your claim for the tax refund.0
