Estate Agents Have Taken Another Person's Holding Deposite

Hello everyone.

My boyfriend and I are trying to move into our first rented house together. We viewed a property that we loved and put down a holding deposite. But the estate agents said that another couple might be interested too.

I rang today and was told the other couple put down a holding deposite (AFTER we put down ours) and that the final descision is now up to the land lord to choose between us.

We are extremely anxious about this. Is this even legal?

    Don't know about illegal but certainly immoral.

    Yes it is legal. While it may not be ethical, Agent may well have done this to give the LL an option on the tenants to pick.

    Of course, who ever loses out should have their holding deposit returned.

    It happened to me once, a long time ago. I was the second person to pay a deposit, and the LA told me that I wouldn't get the property, but luckily for me the LL preferred to le me live there so I did get it. Hopefully in your case the LL likes you best.
  • Thanks so much for the replies, everyone. I guess I'll just have to cross my fingers and hope! Not sure how the LL will be able to decide without meeting us, though. All on paper, I guess. Shame.

    Tell the agent you'd like to meet the landlord to tell him why you'd like the property and how you'll look after it.
    Can't hurt.
    Shows proactivity and might score you some extra brownie points.
