I wasnt talking about my experiences I was talking about how the system works re IB medical reviews and I think you may have been misinformed because people only see one Doctor during a review and not two unless you actually saw two Doctors in which case it must have been exceptional.
I didnt want people to think they would have to see two Doctors each time they went.0 -
sorry it wasnt u i was taking offence to, it was other reply about me having a life of luxury.0

I have been on IB for over a year and was told that my case will not be reviewed before FEB 2008 so its by no means certain that all cases are reveiwed every 6mths.. it will be well over 2yrs till I am eligible for review..#6 of the SKI-ers Club :j

It told me in my award letter when my case would come up for it's next review. But it doesn't necessarily mean you will be called back then.0

IB reviews can be called at any time - it generally depends on the illness/disability.
Some are exempt from review and PCA tests (although they CAN review if they choose to):
"* You are exempt if you satisfy any one of these conditions:
* you get highest rate care component of disability living allowance (DLA), or constant attendance allowance (intermediate or exceptional rate);
* you are assessed (or passported) as 80% disabled for severe disablement allowance; or are entitled to industrial injuries disablement benefit or war pension on the basis of at least 80% disablement;
* you are terminally ill and your death can ‘reasonably be expected within 6 months’
* you are registered blind;
* you have any of these conditions: tetraplegia; persistent vegetative state; dementia; paraplegia or ‘uncontrollable involuntary movements or ataxia which effectively renders [you] functionally paraplegic’.
* You are exempt if there is medical evidence that you are suffering from any of the following conditions:
* severe learning disability – this is defined as a ‘condition which results from the arrested or incomplete physical development of the brain, or severe damage to the brain, and which involves severe impairment of intelligence and social functioning’ (this is less restrictive than the ‘severe mental impairment’ test for DLA mobility component in that it includes conditions such as head injury which arise later in life.
* severe and progressive neurological or muscle wasting disease (eg advanced conditions of: multiple sclerosis; Huntington’s chorea; Parkinson’s disease; motor neurone disease; muscular dystrophy);
* active and progressive form of inflammatory polyarthritis;
* progressive impairment of cardio-respiratory function which severely and persistently limits effort tolerance (eg from heart disease, emphysema);
* dense paralysis of the upper limb, trunk and lower limb on one side of the body (eg from a severe stroke);
* multiple effects of impairment of function of the brain or nervous system causing severe and irreversible motor, sensory and intellectual deficits (eg from a severe stroke, brain tumour, head injury);
* manifestations of severe and progressive immune deficiency states characterised by the occurrence of severe constitutional disease (eg loss of weight, CD4 count below 400, fever, night sweats) or opportunistic infections or tumour formation;
* severe mental illness involving the presence of mental disease which severely and adversely affects mood or behaviour, and severely restricts social functioning or awareness of immediate environment (see below).
Reg 10, Social Security (Incapacity for Work) (General) Regs 1995
* Exemption for those receiving severe disablement allowance (SDA) before 13.4.95
You are exempt if you were in receipt of SDA on 12.4.95 (the exemption continues if you have a break in your claim as long as the 2 periods of incapacity are no more than 8 weeks apart, or 52 weeks if you are a ‘welfare to work beneficiary’
Reg 31, Social Security (Incapacity Benefit) (Transitional) Regs 1995
Severe mental illness
If your medical certificates show you have mental health problems, the DWP writes to your doctor for more information about the severity of the disability arising from your mental health condition.
Guidance advises that severe mental health problems are suggested by a need for ongoing psychiatric care, which may include: sheltered residential facilities where the person receives regular medical or nursing care; daycare at least one day a week in a centre where qualified nursing care is available; care at home with intervention at least one day a week by a qualified mental health care worker; or long-term medication with anti-psychotic drugs including depot neuroleptics or mood-modifying drugs, or equivalent oral medication. The guidance also suggests that exemption should be considered where your condition severely restricts your social functioning or means you are likely to pose a threat or danger to others."

we have a friend whos gone from UB to IB. (wife is disabled)
does anyone know how does this affect their council tax benefit?
the gov site and the local council site were a waste of time!Get some gorm.0 -
DLA Mental capacity
Not sure if this is the right place for this but relative aged 19 has a learning disability. Lives with his mum (single). We have only just found out that she is entitled to a 25% reduction in council tax.
Rules are that they have to be getting DLA middle or higher rate and GP has to agree that it has been diagnosed (sign the form). We were put off because it says for severe mental impairment. You can get the forms from council offices. He does not have any physical or mobility problems.
Have posted this lots pf threads because she has lost out on 3yrs payments, she never know about it.
Morglins post is comprehensive and v. helpful but did not include this. Hope it is useful0 -
There are alot of people out there claiming Incap for back problems but still go about their daily activities with ease.
I am unfortunatey one of these people & whilst not wishing to personally have a go, i think you could have chosen your words more carefully. I can walk, albeit in pain but i go about my daily activities the best i can cos i have to. It is most definately 'not at ease'.
But when you have to attend a medical review its a bit like going through customs at the airport, you feel guilty even though you have nothing to feel guilty about!!
Exactly, i shouldnt feel guilty, but people like you saying what you did about back problems makes me.
I am currently now looking for work and a little bird tells me if I speak to the right people regarding Incapacity Benefit I can get financial help towards interviews (suit and travel). I know a while ago they also gave you a reward for starting work (up to £1000) and finally ending your claim for Incap. It is a good incentive to try and get better and get back to work.
I must say it must be nice to get a financial award to get back to work, you certainly understand the system. But many people cant just 'try & get better.
Two years ago I started Access to Higher Education course, an Advocacy Worker knew someone at Benefits office. She managed to get my course fees £300 paid for. Incap Ben will do anything to stop you from claiming so financial incentives such as paying college fees they deem appropriate. I must point out my claim for Incap Ben was not affected and I am still in receipt of it now. You can also work a few hours a day and it does not affect your Incap Ben I think its no more than 16hrs a week.
Again you understand the system well, thats not a criticism, but an observation. Getting access to a HEC worth £300 quid for free is a very good achievement.
As i said i dont wish to be seemed to having a go at your post, but i am absoultely fed up at people pre-judging anyone on IB. We cant all have a big stamp on us saying whats wrong can we? After reading the other posts no-one mentioned your entitlementy to Ib did they so please think again when posting certain things.0 -
Remember that not all disabilities/conditions are visible, so someone may be perfectly entitled to IB, but still appear to be 'going about their daily activities with ease'.(AKA HRH_MUngo)

Imagine someone holding forth on biology whose only knowledge of the subject is the Book of British Birds, and you have a rough idea of what it feels like to read Richard Dawkins on theology: Terry Eagleton0
