Car crash yesterday
Help please i just need advice I'm so upset.:(
I was crashed into yesterday into the back of my car, the guy admitted full liability he was travelling at around 30miles an hour my head was whipped forward and smacked back into my seat I was up all last night with a headache and neckache my neck is still aching today I have a doctors appointment later.
The thing is I only brought the car last week and the repairs cost more than I paid for it what will they do? How much money will i get or will I even get any???
The insurance people have also said I can't claim for new car seats unless I have receipts well of course I bloody don't they are both over 2 yrs old but I still need new ones cos they've been in an accident.
We are in debt and can't afford new car seats or a new car but our dd's go to school an hours walk away...
None of this is my fault and to make it worse the guy who did it is saying he was travelling at 10miles an hour even though 2 garages have told me he must have been going at quite a speed to cause such damage, he's saying I was fine at the time even though I was sat clutching my head he's even saying he offered to call an ambulance and I refused.Why would he lie, why would people be like that?

DON'T PANIC.
Whiplash isn't like a cut - it isn't always obviousl immediately after an accident. Even low speed impacts/accidents can cause whiplash, so don't worry about the time issues.
As he went into the back of you it is more than likely his fault (unless your brake lights weren't working or you didn't use them). His insurance company should therefore pay it all for you. Your insurers should be able to help you to claim from them.
I don't understand what you mean about the seats - are you talking about child seats?? Why do they need replacing?
Edited to say: if the repairs cost more than the car is worth it will be written off. You should receive a payout for your car, but you may need to work a bit to get what it was worth (first offers are notorioiusly low).:A MSE's turbo-charged CurlyWurlyGirly:A

There are many isues here,and if it was me, with fully comp. insurance i would leave it all to them to sort out.
Even if you only have tpft let them sort it for you,if it was the other persons fault they will recover the costs from his company,assuming he has insurance.
If the repairs cost more than the car is worth they will write it off.You may be able to claim for your injuries.
It is surprising how many people say one thing after an accident,then later change their minds after and tell lies or deny liability,leave it to your insurance company and be guided by them as to a course of action.

to ensure this guy does not disclaim any liability in the future you could contact the police and report the accident... I believe this is a requirement if someone was injured in the accident i.e. your neck

The girl that hit my car was unaware of my injuries (I kept quiet as she was so upset) but her insurers have accepted I was injured and it was they who told me to seek medical help to get the problems documented.
As has been said, whiplash is worse after the event anyway so you shouldn't have any problems provided you make sure your doctor notes down everything you say.0 -

On sunday i was in a car accident but the guy is still not accepting liabilityeven though he admits to running the light hence hitting me. I have been told of the repairs cost more than the value of the car, then they will write it off, and you will recieve the value, but do some independent research into its trade value, as they will always start offering you lower than even this.
If you have legal cover on your insurance you can claim personal injury, just make sure you get to the doctors so the injurys are noted. my whiplash didnt sink in for half hour because of the shock, but by the next day i was in agony and have had to have a week off work doing exercises from the doc so i can move enough to be able to drive the temp car.
If you dont you can go through a third party as long as she admits fault. The AA (who recovered my car) called me to start to the process, unfortuntly due to the other driver not admitting fault at present, they coukdnt carry on, but someone like them will be able to sort it all out for you. Also if she admits fault they will be able to sort out a temp car for you etc at no cost to you.£2 Savers club £0/£150

Dont worry about your car being written off. As you only bought it last week you will be able to demonstrate what you paid for the car. The insurance is there to put you back in the position you were in before the accident so that will mean giving you enough money to buy the same car again
Who told you about teh car seats? Thats not true - I had a small bump with a guy - it was his fault he backed out of a space without looking. Anyway his insurance co called me and I explained that I would need new child seats - they said no problem, just send us the receipt. you WILL have a receipt when you go out and buy new ones.
Please dont get so stressed over this - you pay your insurance for them to manage these things for you. If you have whiplash then you doctor will confirm this - its got nothing to do with the guy who hit you, so dont even bother thinking about what he says - it all looks very black and white as it normally is when someone drives in the back of you.

Hi, thanks for all the replies I have calmed down a bit now.
I am fully comp but it was my insurance comp that told me I can't claim for new car seats without receipts.
I realise the insurance is to put me back in the same position but the thing is I only paid £600 for the car and that's the value it was insured at (in hindsight I'm thinking I should have said I paid more for it but I'm such an honest person these things don't cross my mind, I was asked how much I paid for it and I just said.) I don't think we will have much luck getting another car as good as that at that price.
It's so unfair that we will and already are losing out for what someone else did and then they have the nerve to lie about it.
Have got painkillers frm doc although she did say it doesn't seem that bad, although it's painful to me it's not stopping me moving my head just that it hurts so will I be able to claim for it or does it have to be really really bad
Cos it's still causing me pain and stress. Oh had to leave work early yesterday to pick up kids for me so can we claim for those missed wages?
I don't mean to sound like I'm greedy I'm not I'm just trying to recoup as much of our losses as we can cos my insurance are not telling me what I can claim for they didn't ask me if I'd suffered whiplash or if I had carseats in there I had to mention them.:beer:0 -

As I said try helphire - they may be able to sort you out with a car until you get teh cheque for yours plus they will activly follow up your claims and seek to get you things lie new car seats, compensation, lost pay etc. They make no charge for the service.0
