    You can get a stat dec for anything regardless of whether a case is being held in magistrates, county or crown court. All it is is a means of getting facts verified in writing with the magistrate acting as an offical witness, a solicitors letter would also suffice, but may be more expensive ;)

    But you wouldn't need a stat dec in county court would you? If he has had judgment against him in a county court already, but was unaware, surely you would just apply for the judgement to be set aside?

    I guess my question really is, is it county, or magistrates the OP is dealing with, and what was the disagreement - i.e. was it a monetary claim etc.
