DRO & Joint Debts
Options
Hi,
My Husband has under £15000 of debt in his name but we have loans in joint names that aren't included in this.
Can he have a DRO for the debts in his name only as the creditors will only come after me if he can't pay?
If not looks like BR is his only option.

Sorry but it's to do with 'liability'. He is liable for both his own debts and the joint debts (in full).
There are some debts that are 'excluded' and so don't contribute towards the total: csa arrears, student loans, criminal fines, social fund loans (since the recent rule change). There is very recent guidance that suggests that statute barred and possibly other 'unenforceable' debts can be excluded and I'll try to post guidance on that as soon as it is clarified.0 -

Yep. Advisernet hasn't been changed to reflect this yet and I understand that Specialist Support are going to come up with some clear guidance.
Actually it's about time the DRO Unit released a new version of the guidance notes.0
