    Thanks for your replies

I didn't refuse to let him listen to the speakers, I agreed that before the sale ended. He just didn't want to pay cash and wanted it in writing about listening to the speakers.

Regarding not accepting Paypal I agree it could look suspicious but seeing as I have 2000+ positive feedback that can't really be used as an excuse.

I have been in contact with Ebay and they refunded my final valuation fee as they agreed with me that the buyer had broken Ebay policy by trying to change method of payment.

If ebay have confirmed that cash on collection can be insisted on then that is the Holy Grail of decisions and the one thing that every seller of large items has wanted for years. You need to post that on the community boards as that is a huge turnround decision by ebay.

I've heard it said before, they are obviously aware of the possible problems, I think they did reconsider offering to allow Paypal only to be dropped on collection items but then figured that some sellers would just offer everything as collection only just to avoid taking Paypal and reducing buyer benefits (and indeed Paypal turnover!)

Personally I list larger items with a courier rate (private courier rate if necessary) and offer collection in person. If they want to pay by Paypal they have to have a courier, if collecting they pay by cash, never causes a problem.

as has already been said the buyer has no grounds to sue you.

despite the fact that, technically, a contract is formed when a buyer wins a bid there is little that can be done if you refuse the sale as long as you dont take any money for the goods.

compensation has to be just that, compensation for a loss, the buyer has experienced no loss and a court will only award compensation upto the level of loss incured, i.e, whatever is required to return the claimant to the position they would have been in had they not entered into the contract.

awarding compensation over this level would amount to unjust enrichment. i.e. making the buyer £300 richer than he was before he entered the "contract" which cost him absolutely nothing would unjustly enrichen him, so thecourt would not award him this, in addition you would also be able to apply for an order against him to repay your court costs, so if he tries it he will lose money, not gain it.

i'd ignore him and move on.

with regards cash on collection items, usually people want cash on collection because the item is big and hard to post plus it will be expensive to post, so what i usually do is get a quote for the postage then add a little on for packing etc and list the item as cash on collection prefered but if paypal is chosed then the postage will have to be paid and the item posted by a signed for delivery service for security purposes.

you are not then refusing paypal, but you are refusing collection if paypal is used, which is not against ebay rules.

usually the unnatractive postage cost will put people off using paypa and they will pay cash on collection.

    Exactly.

There was no loss for the "buyer" so nothing to compensate. Ignore him an let him waste his time don't waste yours.
Be sure to block him so he can't cause problems in the future bidding on your items.
