Am sick of ebay fraud! Just having a cry

Just got an email from paypal saying they are finding in favour of the seller in a claim I had started.
I bought a shower on 20-01-07 for £53.50 and the postage said UK was £5, so I paid immediately with paypal from my mums cc (she allows me and I pay her the cash). I sent several emails to the seller to confirm when it was sent so I could arrange somebody to be home to collect it. He/She never replied. Then on 01-02 and 02-02 I got 2 additional charges of £15 and £10 for p&p to N.I, which I refused to pay as we're part of UK so why the additional charges? And why so high?
So still no reply to my emails asking for a bit of communication, I filed a claim 03/02/07. The initial stage gives the seller 10 days for response. On the 12th he provided a track and trace number for royal mail, which clearly shows the item says it was delivered from my local depot but on the electronic proof of collection i.e my signature it says N/A CL, which means not applicable and collection.
Paypal in all their incompentantcys have said I did receive it and I really didnt and now I'm out so much money I just dont know what to do. £53.50 is a whole lot of money for me! That would pay my elec for 2.5 months, or my broadband for 5 months, oh and I still dont have a shower!
I have filed an appeal although I think these people really are stupid or something, I dont profess to be some highly intelligent person but it's clear to see that I didnt receive it.
Oh heres the track and trace number if anyone has an opinion as I'd like to see if anyone can see a signature on it dk953923412gb.
Also is there anyway at all I can get my money back, the shower isnt even at the depot now it's been returned so I cant even collect it, which I would have done if I'd have known and never bothered with the claim

i don't understand - they usually put N/A CL when you weren't at home and they put one of those little cards through the door and you're supposed to collect it from the PO/depot doesn't it? If so, the seller has sent it and surely you're not entitled to a refund if you didn't go and get it???0

Yeah but I didnt get a card through the door, so I didnt know it was there to collect, I only found out on 15th/16th when I was next online and got the tracking number. I have no problems collecting items and regularly do my depot is only 3 miles from me, why didnt they reply to any of my emails and I could have been home to collect though? I am never in my home between 8 and 6 mon-fri0

Just a thought - perhaps your item was sitting at the depot and they didn't bother to put a card through the door. Could it eventually have been returned to sender, which would mean the seller could legitimately claim a further postage charge in order to re-post it to you?
It doesn't help that the seller hasn't attempted to communicate at any point. I'd say it's high time to pull his details and ring him.My TV is broken!
Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j0 -
if you didn't get a card through the door then i would take it up with the PO. IMHO the seller should have replied to your emails but that is all they had done wrong as far as i can see and sometimes there is a delay in the eBay message system. someone correct me if i'm wrong, you still own the shower, and you should just pay the seller postage again to resend. as i've said, contact the PO re: the lack of a card.0

I understand your points but why should I have to pay additional carriage all the time, it is so obviously not my fault. I specifically asked the seller to contact me so I could arrange to be home to receive the item, and I have taken issue with royal mail. Is it my fault that I go to work and cant be there, I realise it is not the sellers fault that royal mail are completely incompetant, but surely he has a duty of care too.
Maybe sellers see this differently, when I sell items I always keep in regular contact with my buyers to ensure there are no problems, maybe I have high expectations of others too

Yes, the buyer should have communicated, but at the end of the day it's up the RM to put a card through your door, and they didn't.
If you're aware that your item is at a depot (because of a card though the door or otherwise) you're expected to pick it up.
If you'd posted something and believed that the buyer didn't bother to collect from the depot, and it had been returned to you, would you cheerfully post it again (to someone who might not even bother picking it up the 2nd time) without asking for more money for the 2nd lot of postage?My TV is broken!

This is really very much, primarily, a Royal Mail fault, rather than a fault on the part of the buyer or seller.
If one was to apportion blame, though, I think it would be entirely to the seller.
Not responding to emails is both extremely rude and very unprofessional.
Had the seller told the buyer that the item had been dispatched and what the tracking number was, the buyer would have been able to ascertain what was going on and collected the item.
To my mind, the seller should definitely bear the cost of reposting because they have not supplied the item nor did they supply sufficient information to enable the buyer to collect the item.
Bear in mind, though, that most of the people posting here are sellers, so the answers you get will mainly be from a seller's perspective.
Make sure that when you action the paypal appeal you make it very clear to them that the only reason you are not in possesion of the item is because the seller made no attempt to communicate with you.
If the paypal appeal fails, consider getting your mother to do a credit card charge back.0 -
Moglex! I appreciate you're trying to help Cathy and I am not having a go. I just completely disagree! Firstly, you say that "primarily" this is a RM fault, yet then say you would "apportion blame" to the seller - surely that is a contradition? Why, if it is primarily RM's fault? Secondly, I am unsure that "most people posting here are sellers" - I sell but buy in equal measure and I am sure the other people who have bothered to post a reply, as I am, are trying to ascertain the fairest solution. Thirdly, while what you suggest in your penultimate paragraph may help the sellers case, this is not the case. She is not in possesion of the item, not just because of the sellers lack of communication. I am sorry but I stand by my original advice. The seller should have communicated but is under no obligation to and this may have been for reasons out of their control eg. message delays. It is RM fault and OP should pay for postage again, hope her local postman is more competant this time and take it up with RM for a refund.0

Yes I completely agree with you it usually is rm.
New information has now come to light, I have infact signed for this item, although what I received wasnt a shower it was an empty envelope with the senders details as DVLA Swansea. I did sign for this and kept it as at the time, I thought it had something to do with that bomber. Thank god I kept it, as I now have it as evidence that it is most definately not a shower! Same tracking number on it and everything. Phew oh I did forget to mention earlier that this guy on the 12th Feb was no longer registered with ebay, ding dong alarm bells where ringing.
Thanks to all that replied, I know it seemed I jumped the gun but I try my best to be a good buyer and seller and just appreciate others to be the same.
