Prove it letter ignored

    HO, I fully agree with that of course. What puzzles me the most is the poster's statement that he had no PCNs attached to the vehicle. Yet there were 14 of them? I mean, one or two could go missing...

    It will be hard to reconstruct when I had the car, when I moved etc. I have had quite a few cars and moved a few times, I don't tend to keep records of the old cars etc.

    Is it my job to prove I am not aware of any fines being due, or do they need to prove to me that I do? After 5 years and the comments so far it sounds like I am going to struggle here which worries me. Can they really demand over £2k from me after 5 years when I haven't got a clue what it is about? Surely I am entitled to some proof from them or they could just write to everyone demanding money like this for alleged offences from 5 years ago!?

    I am not in employment at the moment, certainly cannot afford over £2k and certainly not for something I firmly believe I do not owe!
    They have given me 7 days or threatened me with a 3rd part debt order, statutory demand in bankruptcy etc. I'm worried someone is just going to turn up wanting to take goods from me for this. Doesn't seem fair one little bit.

    I would go ahead and post on pepipoo. The HCEO could pursue you by way of a Stat. Demand and then get you before a judge to prove your income/outgoings but one wonders what the advantage to the HCEO would be? As for bankrupting you whilst that's possible it will cost them to do so and given that they only exist to make money from what they recover that will achieve precisely zip.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    OK, it's obviously going to have to be sorted. Pepidoo is good for that, but keep watching this space too.

    Just to give you a head up on bailiffs.

    Bailiffs don't have any right to enter your house by force. Either you allow them in, or they can let themselves in if you leave a door or window open or unlocked. Usually they assume you don't know this and will try and walk in if you open the door to them. Or trick their way in- "can I just use your toilet, I'm desperate" type of thing.

    On no account let them enter because once they have come in the first time "peacefully" that then gives them the right to enter by force on subsequent occasions.

    If you have a car, don't park it near your house.

    So keep all doors and windows locked, and invest in a chain for your front door. So long as they cannot gain entry they are effectively powerless.

    Just be prepared for the bullsh*t they come out with, they are serious liars.

    Just telling you this as the last thing you need is them giving you a hard time before you manage to get it sorted and find out what the **** is going on here!

    Have you contacted Liverpool City Council? They are your first port of call.

    Unless they have photographic evidence of the PCNs on your car AND prove that they have sent letters to you in the past, I very much doubt that this could be enforced.

    True, one would hope these can be re-set back to PCN stage - but the first port of call for the OP should be pepipoo:

    I think he/she will have to file certain forms with TEC very quickly.

    For the OP:

    TEC = Traffic Enforcement Centre (the place to contact once pepipoo have explained it, to get the PCNs re-set)
    TMA = Traffic Management Act (The regs the PCNs were issued under).

    And finally DO NOT pay the bailiff. Not even if he bullies you, keep the door shut. You need to get these PCNs re-set and that will mean contacting TEC, pepipoo can help you with all of this so get over there now.

    It is very relevant that you changed address several times and that you sold the car, this explains why you may have had no letters througth no fault of yours.

    Is this Newlyns by any chance?

    They have a track record of sending out letters for PPC tickets but placing a council reference number at the top of the letter. In past cases they claimed that these were a one-off mistake, but clearly this is a deliberate tactic.

    To the OP. The car park in question. Was this a council car park? Or one operated by a private company like NCP perhaps?

    In addition to the above, Newlyn's were clearly acting as debt collectors, however tried to imply that they were acting as bailiffs in order to make it more scary.

    I wonder if this situation is what has occurred here? I could be wrong of course, but if the OP knows who managed the car park in question it may provide a clue. Other than that, please contact Liverpool City Council and check out the reference numbers.

    It's a thought, but if the OP accurately reproduced their letter then they have repeatedly stated they are acting for the City Council. The whole thing looks decidedly odd, though.

    Once the civil bailiffs have been ignored thrice, thats it, they just mark it down as a debt.
