Tesco Contamintaed Petrol - Can I Claim?

Hi,

I filled up petrol a week or so ago in Tesco and have noticed that my car stutters..

I ve today had to spend hours draining the old fuel ...

Does anybody know whether I can claim against Tesco, since they have denied liability?

You certainly could attempt to however it is down to you to prove that on the balance of probability they were negligent and not for them to disprove.

As already stated the burden of proof is on you.

There is supposed to be a report published today on the expected cause so that may help to substantiate your case.

Just be sure to keep your receipts as suppliers may accept liability once the real cause is known.

General advice seems to be KEEP a sample of the fuel and fuel purchase receipt. Get professional advice that there is something wrong with the car - not just your opinion and that it is not related to a "normal" part failure...plugs etc. If it is shown to be fuel related then there is a possibility of claiming compensation - not going to be resolved quickly though

I think it is Trading Standards officers who are conducting the investigation, so might be worthwhile talking to your local office to see if they can give advice on the findings.

I would think that if Tesco or Morrison are proven to have sold faulty petrol, then they would put their hands up and provide a helpline for affected customers rather than continue to deny liability in the face of the evidence, but it does depend on your proving that the bad petrol was in your car and was bought from their station.
