Iva and dla

Hi, my husband And I are in an Iva and recently my son has been awarded dla but I am the trustee who has to ensure its used appropriately for his needs. Can the Iva try taking this?

    The DLA will be counted as income, however, it is for your son's needs and any decent IP should offset the income with the equivalent in necessary expenses for your son.

  • Don't forget to tell tax credits, if you are entitled to it, that you have been awarded DLA, as you may be entitled to extra tax credits. Whether your IP will want some of the extra tax credits, I'm not sure.

    The extra tax credits are given by the government in recognition of the extra costs needed to look after a child with a disability, so I would presume the same would apply for tax credits as DLA, but I'm not sure.

    The extra tax credits would count as increased income and may lead to an increase in payments, but the DLA is not to be touched at all.
