    Yup..... if you think of many retailers, they often have the same parent company / come under the same "umbrella organisation" but each retailer could have it's own set of T&Cs - perfectly legal.

    This thread has talked about full time employment. As a part time worker who works approx. 24 hrs. per week contracted but who regularly works extra hrs. to cover staff holidays and sickness often working up to the max 48 hrs. in health care, surely you should get holiday entitlement on extra hrs. up to the standard hrs. classed as a full time post e.g. 38/40 As bank workers get holiday on what they work it thus would not be fair to part timers not to get additional holiday entitlement up to a full time post

    What is fair and what is legal are two different things (although we hope by now that the OP has resolved their situation.)

    It may not be fair that if you have a p/t contract but regularly work overtime that your holiday entitlement is based on your p/t hours, whereas your colleague on a bank or zero hours contract working the same hours as you gets holiday pay on all their hours.

    It is, however, legal.

    The remedy is to request that your p/t contract is amended to reflect the hours you actually work on a regular basis. Or decline the overtime.
