HSBC - Offer, not convinced!

I've been chasing HSBC for the best part of a year now for my PPI back. I first wrote to them last May.

Today I received a letter from them saying they would pay £19.65 for ONE month of PPI - January 2005. They claim that the account was opened in July 2004 but because that's over 6 years ago they can only prove I paid PPI for the one month in 2005.

I've just spoken to them and said I'm not happy because of the amount of time it's taken for them to give me the information I need, but as per usual with HSBC they just don't care.

The FOS weren't very helpful to be honest, they told me to get in touch with the ICO. Not sure why. Bit annoyed at the moment so don't want to phone back.

What do you think? Should I push for this other 6 months worth? Do they really get rid of everything after 6 years or is this a way of putting people off. Also, maybe I'm counting wrong or the banks are weird, but 2005 is 7 years ago now anyway.

So frustrated with HSBC, they messed around for so long with the bank charges claim and then told me they thought £2k in 4 months was fair, and now this.

    they only keep their credit card records of 6 years (or 7 in this case), so if you want your premiums back beyond that then supply them with your credit card statements to prove you paid PPI in those months.

    The FOS have told you to get in touch with the ICO because part of your complaint is that HSBC are saying they do not have records. Did you send HSBC an SAR to get copies of all your records. If not I would do this. You may find their archived records have more information (or not). If you started paying PPI in 2004 and stopped before 2006 then the one statement they do hold in 2005 may be literally all the information they hold - if you don't have any other records yourself and nor do they then there's not a lot anyone can do. If you were still paying it later than 2006 an SAR should provide more records showing this.

    Yes, I send a SAR for all my accounts, they just came back and said no information available.

    May be a little naive, but because I was still paying these accounts of f in 2010 through collection agencies I thought they'd still be open. But of course, they aren't.

    I'm just so annoyed that they are being so awkward. I mean, considering how long I've had to wait, and the number of letters I've had to send, you'd think they'd be able to say okay, we know you paid £19 in Jan 05 so we'll refund that for the other 6 months of 2004. Out of goodwill.

    Although that's me being utterly stupid because banks don't care, as long as they have their money they're happy. I've claimed successfully from other companies without these issues, just HSBC who are dragging their feet and coming up with all the excuses they can find. Just feel if they'd dealt with this in May/June last year they WOULD have had that information.

    I can understand why people don't bother now.

    Why not write again to them saying this?
    If no good comes of it, just enjoy the £20 and be thankful no really large amounts of money were involved.

    like what FOS said, if you have beef over them not holding the records contact The Information Commissioner's Office (ICO).

    record keeping isnt a FOS issue.

    Roonaldo, I wasn't aware of that when I phoned FOS and now I have more information I know where I stand. Plus, not a credit card - but that's beside the point. My beef isn't so much with not holding the records it's the fact if they'd not dragged their feet the complaint would have been dealt with nearly a year ago and they would have had the records, so yes I can see why the FOS would have told me that, but still I am making a complaint about the service and length of time the original complaint has been dealt with.

    I have drafted letter back to them, and have spoken to ICO who have told me that yes they may be able to help. Let's see.

    I don't think a complaint of that nature would get anywhere since they aren't required to keep records for an indefinite period.

    Also noteworthy is this;
    "The organisation should give you the information in writing but they need not do this if it is not possible, if it takes ‘disproportionate effort’ or if you agree to some other form, such as seeing it on screen. The Act does not define what disproportionate effort means but we think the following should be taken into account:

    the cost of giving you the information;
    the length of time it will take;
    how difficult it will be;
    the size of the organisation; and
    the effect on you of not having the information in permanent form."

    i too had a letter today offering me 1 months PPI on CC!!!!!! Again saying to forward statements for dates prior to the offer. However in the same letter I also got redress from a loan dating back to 2001. My question is, if they dont have statements showing payments of PPI for credit card beofre 2005, howcome they have got info about my loan?

    The answer is that the Banks don't dispose of old information in a methodical fashion. Some people can have a SAR returned with a wealth of information going back into the late 1990's, whereas others might not return anything older than six years. It's also still true that some stuff gets archived which should have long been destroyed and (to a much lesser extent) vice versa.
    Banks and other institutions are slowly improving their methods of data storage, but that only makes it more likely that in future only the most recent information will be available as older stuff is automatically deleted.

    Thanks for info. I have a lot more questions about my redress which HSBC have upheld today. It took just 8 weeks and I applied after reading all the info on this site. I phoned them first. They then sent the questionaire to complete. So thanks to everyone on here who helps us. However not to sound greedy but I calculated all the premiums that I had paid with nothing added on to be about £7000. HSBC have noted all PPI redresses and then added the 8% and this is less than the ammount I calculated. I will be contacting them next week to address the actuall amounts of PPI that I paid as they do not total what I have clculated them to be. :beer:
